The July 18, 2023, Alcester City Council meeting was called to order by Mayor Lukas Driesen with a recitation of the Pledge of Allegiance by the council and members of the gallery.  Present were Councilwoman Darla Reppe, Councilwoman Kendra Hatle, Councilman Kerry Hedden, Councilwoman Cyndi Peeples, Councilman Kyle Van Den Hul,Brian Johnson, Alcester City Attorney Sam Nelson and Alcester City Attorney Austin Felts.  This happened before recording began.

Agenda item #3  Approve Agenda.  Approved

Agenda item #4  Public Input  (00:19.39) Public input was received by Councilwoman Cyndi Peeples and Councilwoman Kendra Hatle.  (00:08:26.47) “Bookkeeping schooling” from an unknown female. 

Agenda item #5   Community Center/Golf Course  (00:13:23.30)  Update was given by Landon Nygard.  Discussion of needed a double door freezer.

Agenda Item #6   Employee matter   (00:21:41.67)  Executive session SDCL 1-25-2.1 discussion from 6:23 P.M. to 8:19 P.M. which given the roll call vote taken at 7:53 P.M. in the July 24, 2023, special meeting, culminated in the termination of Patricia Jurrens as Alcester City Finance Officer. 

Agenda item #7   Police Department  (00:22:46.41)  Discussion and updates included the ever present need for part-time law enforcement, the need for hire wages for the department and the lack of cooperation between the sheriff’s department with regard to mutual aid situations.

Agenda item #8   Legal Updates (00:40:24.84)  After the action discussed in Agenda item #6 any need for update was not shareable.

Agenda item #9  East Clark Building Permit  (00:40:38.43)  This issue involved a commentary by Cecil Gylfe and John McDaniel with regard to the railroad easement and FCS building permit.  At no point in the video nor in Finance Officer Pat Jurrens rendition of the July 18, 2023, city meeting minutes did I hear or see an approval to issue a building permit to FCS for their scales.  (00:52:27.70)  Executive session SDCL 1-25-2.3 Legal counsel in at 8:49 P.M., out at 9:12 P.M.

The October 17, 2023, Alcester City Council meeting was called to order by Mayor Lukas Driesen with a recitation of the Pledge of Allegiance by the council and members of the gallery.  Present were Councilwoman Darla Reppe, Councilwoman Kendra Hatle, Councilman Kerry Hedden, Councilwoman Cyndi Peeples, Councilwoman Julia Sundstrom, Councilman Brian Johnson, Alcester City Assistance Finance Officer Abigail Moore and Alcester City Attorney Austin Felts.

Agenda item #3   Approval of the agenda.  (00:42.03) The agenda was approved with the amendment of adding an executive session 1-25-2.1 to Agenda Item #7 Police Department SDCL 1-25-2.1 Personnel.  Motion was made by Councilman Brian Johnson to approve the agenda as amended; Second came from Councilwoman Julia Sundstrom.  Unanimous vote aye, motion passed.

Agenda item #4   Approval of minutes of the October 3, 2023, meeting.  (01:40.87)   Councilwoman Peeples moved to approve the minutes of the October 3, 2023 meeting with no changes, second from Councilwoman Hatle.  Unanimous vote aye, motion passed.

Agenda item # 5   Public Input (02:01.41)     Vickie Larsen input dealt with revising the existing warrant form and possibly consider app. which would convert audio recording of meeting minutes to written form.  The logic being a back up so meeting data is not missed and as a second source to make sure the minutes are accurate reporting of meeting discussions.

Council discussed the implementation of Banyon Software (accounting program user friendly and suitable for Alcester’s municipal needs).  This discussion was tabled to the next regular meeting of the city council.

          Agenda item #9   Public Hearing.  (00:37:54.27)    Motion and second to adjourn city Council.  Motion carried City Council adjourned at 7:19 P.M.  (00:40:17.55) Motion and second to convene Alcester Planning and Zoning Board convened, (00:40:58.53) at 7:19 P.M. 

(00:42:37.17) 2023-05 change in Chapter 4, section 4.09 of the 2018 Revised Zoning Ordinance Regulations 2023-05.  Simply put, the change reduces the rear set-back on residential from 25 feet to down to 15 feet for multi-family dwelling, single family detached dwelling, single family attached dwelling, all other uses 25 foot down to 7 foot and with the addition of stand-alone garage uses with a 7-foot rear set-back.    Motion to recommend approval of 2023-05 amendment of Chapter 4, section 4.09.  Unanimous vote X6 

(00:43:02.25)   2023-6 change in Chapter 10, section 10.03 (k) of the 2018 Revised Zoning Ordinance Regulations.  Simply put from the current language of the 2018 Revised Zoning Regulations of Chapter 10, Section 10.03 (k)… “In the event a fence is to be constructed on the property line, abutting property owners shall be notified prior to the issuance of a permit.  It is recommended, but not required, that the property owners sign a fence maintenance agreement and file it with the Finance Officer and Union County Register of Deeds…”   to the 2023-06 Chapter 10, Section 10.3(k) change of language presented to the Planning and Zoning Board “…1.  Section 10.03(k) to amended to read:  Chapter 10, Section 10.3(K) “There shall be no required setback for any constructed fence.  In the event a fence is to be constructed on the property line, abutting property owners shall be notified prior to the issuance of a permit.  For a fence constructed on the property line, property owners shall sign a fence maintenance agreement and file it with the Finance Officer and Union County Register of Deeds…” *

Motion was made with a second to recommend approval of 2018 Revised Zoning Regulations amended listed as 2023-06. Unanimous approval.

(00:44:02.89) Agenda item 9(g) which involved approval of the plat for Farmers Elevator Tract, an addition in the SD1/4 of NE1/4 and NE1/4of SE1/4, Section 28T95N, 5th P.M., Union County, SD.  This item was tabled due to a question on a private residence being assigned to FCS.  Also. the lawsuit FCS launched against the City of Alcester and Tristam Rhoads family has not been resolved.

          Agenda item #10 – Legal Updates (00:55:25.28) Discussion on Building Permits, Regulation and Ordinance enforcement and remedies for those folks who violate regulations and ignore notices of violation.  My comments which I expressed under Agenda item #5 stand.  Folks, please contact your city council representative, the council as a whole or feel free to view the regulations yourselves to seek resolution to any regulation infringements.  Instead of adopting a “tude” about your infringement, look at how it affects your neighbors, your safety, your property taxes, your insurance and your liability.  Think about it.  Just think about that $25.00 per hour the city must pay Geoff Fillingsness to spend distributing violations notices can instead go to reducing your taxes or those taxes of your neighbors.

          Agenda item #11– Banner Associates – (01:20:51.17) Motion and second to pay Banner Invoice # 40853 for $3325.00.  Unanimous X 6 Ayes.   (01:21:25.00) Motion and second to pay Banner Request #6 for $226,857.95.  Unanimous vote X 6 approval of payment.  (01:22:52.72) Motion to schedule public hearing for CDBG and DANR 2024 Funding application.  Date set for public hearing is November 21, 2023.  Unanimous Vote X 6 approval.

          Agenda item #12 – Community Center (01:24:03.56) Visions payment in the amount of $24,000.00.  Motion, Second and Unanimous approval X 6 to pay the amount due.  (01:28:10.56) Bond payment $7,486.83 approval.  Motion, second and unanimous vote X 6 ayes for approval of payment.

          Agenda item #13 – Annual Liquor License Renewals (01:29:11.61)   It is noted here to make mention of abstentions in some of the votes.  This happens when a council member has a pecuniary interest in the vote.  In other words, the council member’s vote could be accused of benefiting, themselves or an employer.The mayor will call for a roll call vote to make a clear record of aye votes, nay votes and any abstentions.

          Agenda item # 14 – Golf Course (01:33:58.84) Golf course discussion on the rental of a John Deere Gator.  Lease amount is $912.00 for a ten (10) month duration of usages.  Motion, second and unanimous approval of entering into this lease.

Oh Mz.Finger-Painter, it most definitely been a long time since I posed for the glamour shots photo. As many folks on facebook or email use memes, quotes and cartoons as identifiers, I use my glamour shot. Not to disguise or hide themselves as you accuse but to remind us of an event, a time or wondrous experience in our lives. My glamour shot visage reminds me of when my sister, Kari and I took our grandmother to Sioux Falls as a surprise for her December 25th birthday. The day was a wonderful outing for a grandmother and her two adult grand-daughters. As we entered the studio, my sister and I explained to Grams that we were there for a make-over. Grams looked around and said in a not-so-quiet voice there were quite a few there that needed a make-over and my sister bolted out of the shop. The stylist/make-up artists did their magic and turned us over to the male photographer who flirted with my 88 year old grandmother much to her delight. Everytime I look at my ‘shot’ and Grams ‘shot’, I remember with love that special day we had together.

If remembering my grandmother with love and affection is living in the past, so-be-it. She passed away on my birthday in 2004, exactly 19 years ago.

Ma’am my blog orginated out of the need for a public response medium ’cause the local newspaper editor, Mr. Hill refused my responses to accusations. I started using videos ’cause I was being called a liar by folks like FOPat. So Madame with your penchant of middle finger salutations, finger-pointing threats and obstruction of our duly elected mayor’s ability to perform his duty, what is your excuse beyond the obvious? My blog is not anonymous. How else would you know how to write me your complaints. You have used your voice to complain to me, however coward that YOU are you fail to sign you litany of accusations.

Now madame, I have elected to publish these virulent anonymous attacks. First to convince the powers that be that our Mayor was indeed under a malicious, venomous attack which pompted his resignation and once he felt he and his family was safe he rescined the resignation. Now madam, I realize you were not alone in sending me 18 pieces (at this point) of malevolent mail. However with this piece of mail, you have proved a pattern of ongoing harassment and threats suitable for charges. As I indicated in a previous blog, I have indeed contacted the police about this situtation as well as I have spoken to the local post offices out of which this mail was delivered. A small town post office usually has a pretty good idea of perpetrators such as you and your coven. At some point your quilling party members will cease to see the value in harassment, and will abandon you to your fate.

When I first became aware of the “Letter to the Editor authored by Ms. Paula Fagre” appearing in the August 10, 2023, Number 32, Volume 136, edition of the Alcester Union-Hudonsite” newspaper, I balanced my choices. Play verbal chicken with a flightless bird, initiate a verbal duel with a saber versus an epee or ‘psycho-analyzing’ the statements made in the letter to the editor.   With that said, let’s start with the paragraph-by-paragraph approach below (the red italicized paragraphs) and determine whether I should call the chicken out or give a sharp slashing poke.

Humbly Ms. Fagre?  Under stress, Ms. Fagre?  I see no humility and I question your choice of blaming your questionable behavior on stress.  You were not the subject of the executive session.  You sent a formal apology by letter for your upset and your quietly rude gestures???  What is this too little, too late?  A variation on the attitude of, “it is better to apologize than ask for permission…”  Madam you state. “… quietly rude gestures…”.  Are you aware you were in a public government building during a meeting in which an executive session was in process and you were just outside the door stomping and wildly gesticulating at the council in executive session?  You were in effect obstructing and threatening with your gestures, government officials in a closed meeting.  Duh?

Ms. Fagre, madame artiste there was no allusion to a crime, I merely asked questions why the City of Alcester in the guise of FO Pat Jurrens who appeared to be working as a gallerist for a private and apparently for-profit entity.  The walls of Alcester City Hall and the Alcester Community Center were in effect damaged and or vandalized for the purposes of displaying this personal art show.  I asked the question, was the city being reimbursed for this ongoing display, the cleaning of this art display, the liability for this art display and the employee time spend in managing and cleaning this display.  The city is not in the business of being your private art gallery.  The Alcester Taxpayers are not paying taxes so you can display your ‘wares’ madame artiste and make money off their tax dollars.   Build your own gallery or rent a storage shed so you can open the doors and sell your “art” on the weekends.   You pay for your own facility, You pay for your own advertising and You collect your own cash instead of floating it through the city coffers.  The council did not give its permission to be a gallery for you.  Your inference we should be grateful that you are bringing people into Alcester with your art is ludicrous and presumptuous.

Assuming that I am that lady accused of hating your art or hating your person.  First “madame artiste”, I am no lady and I do not have the title Dame before my name either with an “E” or without an “E”.  I have my own art appreciation.  As to hating you, at this point I have no interest in you one way or the other.  However, that could change given your propensity for libeling, slandering and threatening our duly elected public officials via media venues or in public hallways.

Ms. Fagre, I spoke to the appearance of former Finance Officer Patrica Jurrens acting as a curator or a gallerist. Your reference to former Alcester Finance Officer as your personal gallerist is in error.  I did not say former Alcester Finance Officer was your personal gallerist.  I never got an answer to my question dealing with that subject during council as to what exactly was going on with the art. Why? Because the council was unaware of FOPat’s apparent failure to get the council’s permission, contract, agreement and there was no vote to approve your art display in the city offices or the community center.  Where by the way, YOU are still displaying your wares in the community center and we the people have no idea what the accounting, sales and etc. is taking place. We want that accounting.   You forget Ms. Fagre it appears to have been FOPat and only FOPat who was “allowing” your “Art to be Hung”!  Madam Fagre your guesses are irrelevant.

Ms. Fagre the fact you ‘don’t think” says it all.  Ya dumped your ‘art’ on the city, expecting the city employees to take care of it for you on the taxpayer dollar.  WOW In addition Ms. Fagre, I cannot speak to how amazing your husband is or how much of a freak you are no, matter how tempting.

Ms. Fagre, I would not ever try to guess how much you spend on your canvas, acrylics, alcohol ink, wood planks or you Gandma Moses frames.  The hours you spent on your “art” are valuable only in that you are not harassing city officials when you are huddled in your dark studio, creating your art.

Ms. Fagre what you have or have not donated is not pertinent to your behavior toward our mayor and council members.  I am not inclined to give you a free pass on your behavioral ‘upsets’ just because you donate some canvas, paint and alcohol ink or offered up a crocodile-teared written apology.

Ms. Fagre I am not interested in what you have tried but how many people have been bullied by you in those endeavors.

Ms. Fagre your husband’s personal health problems are not relevant to the discussion we are having.  However, the broken rib just might be relevant, did that happen the night you visited City Hall and showed those present in the hallway how many foul words you had in your vocabulary?

Ms. Fagre, I am sure HE is grateful for your service. 

Ah Ms. Fagre, there is the rub.  You brag about the town but you degrade and threaten our public officials in person and in social media.

Ms. Fagre perhaps you should have been just as devastated when FOPat was harassing our former Finance Officer who was gravely ill.  You should have been just as devastated when she tried to have a young man arrested on false claims via 911 calls or upset with the lies, she has told to the council and the public.

Ms. Fagre do not confuse fact for Pat’s fiction or crafting a crown from the pikes of a Yucca plant.  This has been a long time coming and too many residents have been victims of FOPat’s actions, consistant failure to do the job she was paid to do and her manipulations of robbing Percy to pay Patty.

Our former Finance Officer Mike Kezar was doing quite well, he did have an assistant but Mr. Kezar did not have delusions of being City Administrator.  That was all FOPat!  Quite frankly it is my opinion that FOPat did not want anyone to know exactly what it was she was doing and what exactly she was failing to do.  FOPatty do petty issues?  Nah, she wanted the big top, center-ring show grabber! 

Ms. Fagre as far as asking you about anything, it would seem from recent experience it all depends on what time of the day we would be asking.  After the witching hour or when the needle on the glass registers E?  By the way how was it you broke a rib? So far madame artiste you have not conducted anything in private as it relates to our mayor and you have been more than willing to share your opinion, your prejudice and your vitriol in person and on Facebook which albeit was taken down, H-m-m!

Ah Gee for someone who. “…could not care one little bit about credentials…”  Ya sure do know how to list them ad nauseum.  Ms. Fagre you go on to say, “I only look at how a person lives and operates…”  So, ma’am taking your own justification for what you look at in how you judge people, YOU are giving me permission to look at how YOU operate and how YOU perceived how FOPat operates.  Ma’am when did you last have YOUR vision checked, H-m-m? Oh by the way Ms. Fagre, do you know how long Mr. Kezar was Finance Officer when he was dismissed? Over thirty years Ms. Fagre. What was his wage at his dismissal? $35K plus or minus. So what was Pat Jurrens starting wage as Finance Officer with no experience? She was hired with no experience as finance officer at $2000.00 more than what Mr. Kezar was making after 30 years of service to the city with an raise to $40,000.00 a year after a short trial period. Still want to hand out thorny crowns to your bestie?

Ms. Fagre throughout this diatribe you appear to make extensive use of the party favor word “hearsay” and you have sprinkled “misinformation” like the confetti bombs at a Reveal Party.  By the way, did you use your special alcohol ink for your vitriolic, verbal and venomous assault on our elected officials and reporters? Correcting your analogy of “a never-ending, spinning toilet bowl…”  Ms. Fagre a toilet bowl does not spin, the water spins  a- n- d  ma’am the spinning water stops when the defecate is removed through that big hole in the bottom of the toilet bowl! 

I have already corrected your numerous errors in spelling in the above paragraph because I do not want to perpetuate your mistakes. I have referred to the Alcester Community Center as “an Albatross” not big and not white.  You added those terms.  In addition to characterize the Alcester Community Center as beautiful.  Ma’am from what I gather is YOUR definition of beautiful, “Beauty” is definitely in the eye of the beholder and I most assuredly do not share your concept of beauty. 

Ms. Fagre you chafe, .. It (presumably my video blog) is allowed to be printed and filmed and shared among the airwaves…” Madame artiste, remember what the U.S. Constitution says?  Amendment I Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Ms. Fagre, you inventoried you varied accomplishments and trotted them out like grocery coupons in the local newspaper.  Ma’am when you were graduating high school, I was graduating college.  I was proud to be the first in my family to achieve a college degree.  My grade point was not necessarily noteworthy because I paid my way through school.  While I attended a local two-year community college, I went to school during the day and at 4:00 I was punching in at the time clock at Berkeley & Company.  I worked from 4:00 pm to midnight, five days a week year round.  I earned $1.80 per hour, $.10 of that was shift pay.  I ran machines, molding machines, I ran 45 braiding machines which produced braided rope and spooling machines which transferred the plastic strands onto the spools for the braiding machines.  From Iowa Lakes Community College, I went to Northern State College in Aberdeen where I finished out my BA degree in English, with a minor in History and the equivalent of a minor in science due to my insistence on getting a BA degree not a BS degree.  Yes, I am proud of that accomplishment! 

My other accomplishments along the way are only relevant to those services to people along the way.  The good people of Alcester are aware of some of my accomplishments, but not all of them.  Some of what I did was anonymous by choice.  I did not feel the need to brag about them when it may embarrass a recipient or when a pat on the back was better served being attributed to someone else.  So as I said, the good folks of Alcester are aware of my contributions to Alcester.

I do not carry a sign either figuratively or in reality declaring, “Welcome to Hellcester”.  Folks that is a malignant, malevolent characterization of Ms. Fagre’s design.

          Ms. Fagre says, “…without reminding citizens of this beautiful little town…”  Sugar ya’ll spouted an Oxymoron ie. “…without reminding…”, but then ya’ll remind them.  Oh by the way Ms. Fagre, I took a class titled, Semantics.  It was a great class.  The South Dakota Motto, “Under God, the people rule” is often interpreted “if the people believe in God, they rule”.  However this is open to interpretation.  What if it really means God has set out the rules to the people, the people must abide by and uphold those rules then and only then the people will rule?

One last thought for you about me Ms. Fagre … “en Garde!”,

I read a redacted version of this statement to the council.  I was limited to three (3) minutes for which I did not plan and therefore it came off disjointed until the end.

“This concerns the rapid, flimsy and questionable excuses with which the Alcester City Attorney Sam et.al. are attempting to unseat our Mayor Lukas Driesen.”

“The time starts with the pre-election steps Lukas Driesen took to run for the seat of Mayor of Alcester, SD.  Mr. Driesen contacted Finance Officer Patricia Jurrens for the number of signatures he needed for his petition for mayor…” Alcester is a Second Class Municipality.  A second class municipality defined in South Dakota State Statute is a city with a population between 500 and 5000.   According to SDCL 9-13-9, the number of signers required for nominating petitions in first, second and third class municipalities…Time for circulating petitions.

9-13-9. Number of signers required for nominating petitions in first, second, and third class municipalities–Time for circulating petitions.

In municipalities of the first and second class, if the candidate is to be voted for by the voters at large, a nominating petition shall be signed by five percent of the registered voters of the municipality based on the number of registered voters recorded by the county auditor on the second Tuesday in January of the year of the election. No petition need be signed by more than fifty voters.

If the candidate is to be voted for by the voters of a ward of a municipality of the first or second class having more than one ward, a nominating petition shall be signed by five percent of the registered voters of the ward based on the number of registered voters recorded by the county auditor on the second Tuesday in January of the year of the election. No petition need be signed by more than fifty voters.

In municipalities of the third class, if the candidate is to be voted for by the voters at large, the nominating petition shall be signed by not less than three registered voters of the municipality. If the candidate is to be voted for by the voters of a ward of a municipality having more than one ward, the nominating petition shall be signed by not less than three registered voters of the ward. A petition signer in a municipality of the third class is not restricted in the number of petitions which the person may sign.

No nominating petition may be circulated until on or after the last Friday in January before the election.

Lukas Driesen achieved his signatures and was duly elected Mayor of Alcester, South Dakota.  Alcester Finance Officer Patricia Jurrens administered the Mayoral Oath of Office to Lukas Driesen.  Then Alcester Finance Officer Patricia Jurrens flatly refused to hand over any of the tools of the officer of Mayor which included Keys to offices, keys to any and all municipal buildings and city owned properties.  This blatant insubordination was just another act in a long line of insubordinate behaviors, lies, inexcusable failures to perform her duty, failures to supply accurate and complete information to the duly elected city council and residents and a history of violations of South Dakota statute it became necessary to terminate Finance Officer Patricia Jurrens.

from the position of Alcester Finance Officer, terminating her employment on or around July 6, 2023, with a formal confirmation by roll call vote of the Alcester City Council on July 18. 2023.  This process can be viewed and heard in the video presented at www.avoicefromthegallery.com dated July 24, 2023, time stop (00:18:50.90)  AGENDA ITEM #4 with a unanimous vote of the council.  

Unfortunately due to threats and aggressive behaviors toward Mayor Driesen, he offered a letter of resignation but as I understand the situation the letter was not presented to anyone on the council nor the city attorney.  It was just passed on. The council under the direction of President of the council, mayor pro-tem Darla Reppe did not act upon or accept this resignation ‘document’.  On July 26, 2023, Mayor Driesen rescinded that resignation with a written document of rescission of his previous document of resignation and copies of the signed and dated rescission were distributed to the members of the city council.

However, City Attorney Sam Nelson Through Attorney Austin Felts stated the first document stands m and made no comment on the rescission document.  Now let’s talk about the history of the presence of the firm of Frieberg, Nelson and Ask. Attorney at Law as Alcester City Attorneys.

January 8, 2018, the Alcester City council voted to approve the 2018 Retainer agreement between the City of Alcester and Attorney Charles Haugland of Gubbrud, Haugland and Gillespie Law Firm.  Motion was made by Alcester City Councilman David Larsen to approve the retainer agreement, with a second coming from Councilwoman Darla Reppe and with all members of the council having a true and complete copy of the retainer agreement, the council voted unanimously to approve the retainer agreement between the City of Alcester and Charles Haugland, Attorney.

However, on January 9, 2018, Mayor Tom Glass and City Finance Officer Patricia Jurrens hot footed it down the street to Mr. Haugland’s office and announced, “the city council felt that it was ‘time for a change’ concerning the retention of Mr. Haugland’s Law Office and Mr. Haugland in particular…that the city intended to retain Tom Frieberg of Frieberg, Nelson and Ask as the new City Attorney for the City of Alcester…”  With Glass and Jurrens comment he (Mr. Haugland) would remain until sales documents were completed.  Mr. Haugland responded, “NO!”  Mr Haugland tendered his Letter of Resignation January 16, 2018.

WOW the council of two, Glass and Jurrens ‘decided’ it was time for a change less than 24 hours after the council voted unanimously to approve the retainer agreement which awarded Mr. Haugland $105.00 per hour for his legal services.

There was no meeting on January 9, 2018, for the council to meet and decide… JUST Glass and Jurrens yapping.  Now folks about that ‘new’ retainer agreement.  Moving on to the February 5, 2018, council meeting where Tom Frieberg is seated at the council table, n ote vidieo.  Man,  Mr. Haugland’s seat did not even have time to get cold.  Now Mr. Tom Frieberg is called upon to review the ‘New’ 2018 Retainer Agreement which awarded $150.00 per hour fee to Tom Frieberg and $125.00 per hour fee to Mr. Sam Nelson..  So who wrote that ‘New’ 2018 Retainer Agreement?  Was it Finance Officer Patricia Jurrens who had already pinched Mr. Hauglands work-product to suit her ‘needs’ or was it Councilwoman Melissa Kay, a law student?   After Mr. Frieberg’s ‘review’, Councilman Dan Haeder moved to approve the ‘new’ 2018 Retainer Agreement, using Freiberg, Nelson and Ask Law as the city of Alcester’s new city attorneys. I gotta wonder if ol’ FOPat was a client of Frieberg, Nelson and Ask.

Now Finance Officer Patricia Jurrens does not like or trust Mayor Lukas.  Her words not mine.  UP STEPS the firm of Frieberg, Nelson and Ask opine-ing and arguing Mayor Lukas’s letter of resignation stands…but his letter of rescission (The revocation, cancellation, or repeal of a law, order, or agreement. “the plaintiff agreed to the rescission of the agreement”) does not?  

  They are both legal documents and duly signed and dated.

Then there was a hear-say comment that Councilwoman Hatle could take part in the meeting via telephone but she could not vote.

From 08/30/2020 through and past the date of 03/15/2021, the city of Alcester carried telephone participation where absent council members participated and VOTED via roll-call vote via telephone.  As well as our city attorney Sam Nelson has on numerous occasions taken part with opinions etc. when he has been away in Pierre Lobbying or whatever called him away from our council meetings. 

In the October 2, 2019, meeting held in the Alcester Golf Course ‘clubhouse’ I made a comment on how often a lawyer was correct.  Something to the effect that a lawyer is only right half the time and I asked him (Sam) which half he was working on?  With that said, please take note of my video of April 15, 2019, where the ballots from the election were being canvassed.  Take note in the video where the ballot box was illegally opened, the ballots were illegally dealt out to the city council members by Councilman Dan Haeder and how Councilman Dan Haeder held the totally empty ballot box up to show my camera.  Big time Election violation, which I wrote up a complaint and filed.  A DCI agent viewed the video when he came to visit me and questioned me regarding that complaint.  NOTE:  the lower left hand part of the video, note that City Attorney Sam was in attendance and sat quietly watching and without comment as to the illegality of what he was witnessing.  Sam was …

There is a lot of crowing local artiste sells artwork to the state of South Dakota. Ms. Paula Fagre, Alcester a piece to the South Dakota Arts Council for the state’s public art collection through the Art for State Building Program. Well there ya go folks! One does not have to look far for the incentive for Ms. Fagre’s ‘piece of work’. The title is, Stillness in the Storm…acrylic and alcohol ink. Ironic isn’t it, alcohol ink?

This artiste likes painting birds, too. She appears to be extremely adept at flinging the bird, flipping the bird while using her alcohol ink. Alcohol ink can be purchased already made or it can be crafted using your favorite brand of alcohol and markers. So one has to assume that she used her favorite brand of alcohol and cut the tips of magic markers,,,H-m-m?

Folks these women and the man-hangers did not just appear on their own, No, I do believe they had a special invitation from FOPAT. Kind-of-like a former president allegedly sent on January 6th of fame to march on a white house or in this case city hall. While the culprets chafed and called out mucas when they were relegated to the hall for executive session discussion of what I have come to understand was the removal of a stain on our community and what would be a simple removal devolved into chaos and threats. A simple reprimand was no longer available, total and complete removal was the curative measure for a long lived infection.

It is time to FIRE Pat and humbly ask Mayor Lukas to stay on as mayor. He has worked hard to understand the workings of city government of a place he calls home. He does his research and acts in the best interests of all citizens. It has come to my attention the madame artiste has been using her alcohol ink to debase and liable our Mayor in social media.

So with that I would humbly ask you contact him and ask him to stay. I would ask the city council to return to the issue of the executive session and remove this blight on our fair city, remove the continuous refusal to follow directives and do her job, so we make a start in rebuilding our fair city’s reputation. It appears she feels she won. We are done with the false 911 calls, we are done with the sexual harassment of employees, we are done with the lies, we are done with our tax moneys moving from one pocket to another, we are done with the never ending fee assessment to offset capping of taxes on our citizenry and we are more than done with FOPAT

NOW IT IS OUR TURN, IT IS TIME WE THE PEOPLE RETRIEVE OUR FAIR CITY FROM THE SHARP JAWS OF GREED, SELF ENTITLEMENT AND A QUEST FOR POWER AND REMOVE HER FROM CITY EMPLOYMENT.

⇒I started my input with the advice when the city responds to a wage complaint they should have the complaining party sign a waiver that the complaint remedy has been mutually agreed upon.

⇒I addressed input on the recent charges of wire fraud against an local accountant with the question did this individual audit the city’s books? 

⇒With the resignation of Mr. Richards as reporter for the local paper and my increase in traveling, the city is without “window washers” to expedite transparency, I asked about the status of live-streaming the council meetings.  I was told it was in progress upon the purchase of a camera suitable to live-streaming capabilities.

⇒I asked about the status of the lawsuit FCS brought against the city and Rhodes family.  City Attorney Austin Felts indicated he could not answer my query due to the ongoing status.

⇒I asked the members of the Alcester City Council be apprised of a listing of all vendors contact between them and Finance Office Patricia Jurrens.

⇒Finally I asked the new members of the Alcester City Council be provided  ALL materials which will they will need to make their decisions, access to all passwords needed to fact check, audit and over watch all departments within the city of Alcester, the members of the Alcester City Council be made aware of the Mayor’s right to have possession of all keys to all city buildings, edifices, offices and grounds and the make sure those keys have been supplied to him by the Finance Officer and over-see that any directions given to the Finance Officer by the Mayor are duly carried out in a timely manner.

          It was my purpose to let the council know the extent of their power and control.  As I spoke to the above issues I stressed the duties, privileges and the right of the mayor as well as I touched briefly on the duties, privileges and rights of the council members.  Alcester is an aldermanic form of government through and by a mayor and in our case a six (6) member council. There is a mayoral-appointed, council affirmed finance officer (bookkeeper) and most assuredly not a city manager no matter how many times she closes her eyes and clicks her heels!  South Dakota is an at-will state where, “SDCL 60-4-4…An employment having no specified term may be terminated at the will of either party on notice to the other, unless otherwise provided by statute…”

(00:39:48.67) Councilwoman Kendra Hatle asked about Beck Drive, its inception and course of construction.  Ms Councilwoman Hatle, Beck Drive Inception began somewhere around Councilwoman Patricia Jurrens’ appointment to Finance Officer. Upon her appointment as finance office Ms. Patricia Jurrens along with Mayor Tom Glass bolted from the gates of the their Alcester soapbox derby of Beck Drive sometime prior to 2015.  On or around June 2, 2015, it was announced by the soapbox derby duo Glass-Jurrens that work on Beck Drive was schedule to begin on Wednesday, irrespective of a bond in place.  So how was the city going to pay for this work, by selling off lots bordering Beck Drive you say?  Around August 2016, the first interest payment on Beck Drive is due soon, and Gee Whiz NOT ONE LOT has been sold to cover the interest payment.  So how much of the HRC Fund is remaining to cover regular wear and tear maintenance on the Four (4) plex AND Beck Drive construction cost…Whose hobby-horse was Beck Drive?…Why Mayor Tom Glas and Alcester Finance Officer Patricia Jurrens spending the city’s money and leaving the west side of town hauling their own water and watching their streets collapse into gravel-filled pot holes.

          (01:59:45.33) PLAT MAP OF LIND SUBDIVISION AS RENDERED BY McLaury Engineering.  Get FOPat’s comment, “…in the near future, WE WILL BE APPROVING the final plat…”  Yo FOPat you do not get to approve anything, you are just the bookkeeper.   My first thought is why in Hades, is the city going back to this engineer on the Bungler Express.  This is the engineer they hired to do the SRTS (safe routes to school) which was bungled and cause flooding for a resident and resulted in a lawsuit to make the flood victims whole again.  Now he is doing a survey.  Folks if you are not familiar with the area, do a drive-by.  Note the significant drop in elevation from the road bed, note the water pathway which cuts its way across the SW tip of the Subdivision.  Now it is going need fill and infrastructure.  It has a straight-line track down first street to the sewer system access.  Take a good look at the travel point and the First street condition.  Consider the cost of sewer, water and electrical access to these homes.  Add in the possibility of some sort of lift station or intermediary transfer of waste materials.  Wanna Guess who is going to pay for this Crapalachian Trail.  Think of those folks on the West side of town whose sewer system could be have been the left-over clay from clay pots of our cave dwelling predecessors. I sure hope a strong feasibility study takes a good long look at all the infrastructure involved in this project.

          VICKIE LARSEN INPUT(00:03:37.30) I spoke to the need for all of our council representatives to have a city email by which their constituents could contact them privately without play “MAMA MAY I” with FOPat.  Residents of the council’s ward would be contacting their Ward representative directly.  Also the Council members would not be receiving emails on any business email accounts they may have. Thus protecting the privacy for both parties and in any unfortunate event that causing a subpoena to be served on a device of a council member, their business persona would arguably be exempt from that demand.

          I spoke to the profit/loss of the community center and the need to make sure the costs and debits created by the operations of the community center were INDEED attributed to the profit/loss of that entity and that if there was a profit that it included ALL costs to the operation and not was just ”crystals in the sun”.  I spoke to the  absolute need to separate the golf club from the community center.  This means ALL labor costs are on the separated books of the community center, all expenses for the community center are ON THE BOOKS for the community center.  This means there is NO picking up labor costs from the city general fund, it means all insurances, sales tax and use taxes are on the community center and are not taken from the general fund, that commensurate property taxes are assessed and applicable to the community center and do not disappear because the city is involved.

          THIS MEANS WHEN THE COMMUNITY CENTER  IS COMPETING WITH PRIVATE BUSINESS IT DOES NOT HAVE A FINANACIAL EDGE BECAUSE IT IS TIED TO THE APRON STRINGS OF THE CITY OF ALCESTER.   IT MEANS THE COMMUNITY CENTER STANDS ALONE WITHOUT ANY SUPPORT FROM THE GENERAL FUND WHICH IS FUNDED FROM OUR COLLECTIVE POCKETS.

I DEMAND A MONTHLY PROFIT/LOSS STATMENT WITH DETAILS ON THE COMMUNITY CENTER!

          I spoke to the credit card issuance for our police department.  The limit on the card for the PD Officer was at $500.00.  Now I believe the Finance Officer has her own city credit card and it has a limit of $1000.00 limit.  Now folks these limits are set and there should be no borrowing from the PD card to offset any over-usage in any “other” department which has slammed head-long into their limit just because they had the administrative power.

          I spoke to the trailer parked on Part street next to the pool.  I asked if the city owned that vehicle, ’cause FOPat has harassed residents for parking their trailers in the streets and threatened to tow them.  This trailer has been in that spot for 30 plus days, I believe the trailer belongs to the house on the corner across from the pool.  Is he going to move it?  I also spoke the proliferation of wood stacked in the backyard of that same dwelling.  Now FOPat has sic’ed ol’Geoff Fillingsness and his citation book on other residents with small piles of sticks but yet this yayhoo seems to get preferential treatment.  Really?

          Lastly I asked the status of the lawsuit Farmers Co-operative Society FCS launched against the city of Alcester in 2022  $CIV22-00048 (00:14:32.33) to which Attorney Austin Felts stated he could not comment as the lawsuit was still active and Attorney Sam Nelson was still involved in the disposition of the civil lawsuit.  My question is what is the hold up for this lawsuit.  I am going to ASSUME (me and only me) there is a conflict in coming to amicable terms, a whole lot of liabilities attached to the city, and now there is a whole lot of lawyer hourly billings involved.  We the people want to know!  What is the stale date on a civil lawsuit, boys?  Best I can tell is six (6) years but at what point after plaintiff filing does that time limit start, Huh?

          COUNCILWOMAN DARLA REPPE INPUT (00:08:52.87)  Councilwoman Reppe spoke to the no-man’s land between the ball fields, abutting properties and easements and whose responsibility for the up-keep.

(00:16:05.03)  AGENDA ITEM #8Police Department  Chief Jared Thompson/Office Kyle Kleinschmit  (00:16:13.87) Chief Thompson was up first and relayed an issue of mutual aid reluctance from the county.  (00:21:16.40)  Officer Kyle Kleinschmit took the podium to report and make a request.  He spoke to many issues involving part-time officer-wise.  He made the suggestion he would be amenable to becoming full time with stand-by capabilities but the hourly rate would have to increase.  Officer Kleinschmit spoke to being to all intents and purposes on-call on his off time hours which interfered with his other part-time job.  The city was aware he had another part-time job when they hired him and were ok with that condition of hire.  Officer Kleinschmit is willing to give up his other part-time employment for full time for the City of Alcester with the raise in hourly rate.

          I (Vickie Larsen) did comment to a past near calamity with 911 where the Union County Commissioners moved the minutes of September 23, 2014, reflect the Commissioners decision to file a lawsuit against the City of Alcester, the City of Beresford, the City of Elk Point, the City of Jefferson and the City of North Sioux City to recover unpaid fees for non-emergency dispatch services provided by Union County to the cities.  Outside legal counsel was sought by the Union County Commissioners.  This information was taken from the January 6, 2015, minutes of the Union County Commissioners and was later approved in the January 20, 2015, minutes as presented.  The 911 process was started in 2012 and culminated with the lawsuit which I believe was reported by Kelly Kruithoff for the Leader-Courier of Elk Point.

          Going back to the police department and paying them for their time.  If we continue to screw around with our law enforcement, no one will want to come to protect and serve our community.  Then we will have to resort to the old stand-by solution of law enforcement, the inflatable cop.  We can park the patrol car with the inflatable cop in the driver’s seat, then give FOPat the ‘job’ of blowing him up, inflating his ego and etc.  However we cannot inflate this officer with helium, ’cause we cannot afford to have a ‘high’ officer.  And we would be obligated to make sure in the summer he is in a cool dark place so the air does not expand and we have an on duty death of our inflatable police officer.  Yes, I already know I am irreverent.   

(00:44:34.77)  AGENDA ITEM #9Pool Employees  Hires  The council voted to hire Jaeley Christensen and Evan Brown as Lifeguards at a rate of $12.00/hour.  Additionally Ava Kingma was tentatively hired as Lifeguard at a rate of $12.00/hour upon successful certification.

(00:53:51.77)  AGENDA ITEM # 10–  Custodian  –    It was announced that our current custodian LeeAnn Haisch resign her position as city custodian leaving an

opening.  Councilwoman Reppe moved to advertise for the open custodian position, second to the motion came from Councilman Hedden, with no further discussion the group voted unanimously to advertise the open custodial position.

(00:55:11.87)  AGENDA ITEM #11  Credit card approval for Police Officer Kyle Kleinschmit with a limit of $500.00.  Motion was made by Councilman Vandenhul, second to the motion came from Councilwoman Hatle and with no further discussion the group voted unanimously to approve the credit card.

(00:55:38.57)  AGENDA ITEM #12Golf Course/Community Center    Discussion began with the question, do we want to sell the parcel with the old golf clubhouse?  Much discussion took place with the group ultimately tabling the question.  My vote would be No, Keep the land get rid of the building either by sale or give away to haul the thing away.  You never know when the land may be needed by the golf course, and the liability of a private enterprises so close to the golf course could prove costly.  Keep the land, get rid of the building.

          Next discussion and action point was the hiring of a cook and a waitress with the application of Danielle Ledgerwood for cook position at $13.00/hour and Ella Erickson vying for the waitress position at $7.42 per hours.  Motion was made by Councilwoman Reppe, second to the motion by Councilman Vandenhul and with no further discussion the group voted unanimously for hire these two individuals.

(01:07:48.60)  AGENDA ITEM #13  – Planning and Zoning  The great Fence conundrum, do we or don’t we.  Looking at five foot set-backs from the lot-line positioning, to on the line fence positioning and who takes care of the demilitarized zone?  This question was tabled to obtain more information.

(01:19:26.23)  AGENDA ITEM #14  – Snow removal repairs –  Discussion took place but no decision was made until Attorney Felts did some digging for information.

          (01:30:42.17)  Discussion regarding the open ‘shelter’.  My opinion is to get rid of it.  Tear it down and replace the tables with concrete tables which seat six spotted around the area as many parks have now established.  Upkeep is minimal.  (01:34:25.17)  Consolidation of the Pleasant Hill Cemetery CD’s.  Motion by Councilwoman Hatle, second to the motion came from Councilman Hedden with no further discussion, the group unanimously voted to consolidate the CDs from Pleasant Hill perpetual care Cemetery to one CD 60 months at 4.1%.  (01:40:08.03) Housing Study vote.  Motion was made by Councilwoman Hatle, second to the motion was made by Councilman Reppe with no discussion and by unanimous vote approved the expenditure of $2500.00.

          (00:25:43.10)  VICKIE LARSEN commented on street racing and grade school golf cart drivers without parent riding shogun.  Streaming cameras,     do we have them and where are they?  I brought up streaming in past meetings and no response.  Folks want to be able to watch the council meetings live without Facebook P.M. ranting after-the-fact, FO prejudiced ravings, mis-information handed out like Halloween candies and just plain withheld information or long lines in the city hallway during lengthy and unnecessary executive sessions.  Let’s talk about the cameras.   Councilwoman Reppe said there are cameras in the community center.  I asked if there were any cameras in the Council room?  After a long pause    FOPat answered yes, there was a camera in the city offices but only after hours.  Does that include the audio-eavesdropper Alexa or Echo?  I asked where the camera was located.  A hand motion toward the file cabinets on the west wall indicated the location of a camera.  There are no postings       warning of a camera in the offices.  How long has that little ol’ camera been sittin’ there?  Where does that little ol’ camera send all those video’s?  A-n-d can one log onto that little ol’ camera so she can watch the video real-time when she has been expelled from an executive session and sitting in the hallway with her nose in her phone?  Gotta wonder,  Trust?   Now let’s talk   about the ‘art gallery’   Is the city getting a commission on the sales of galerie d’art?  The answer I received is no, so who is paying for FOPat to act as curator for madame’s art?  Do we (the city) have a waiver of liability for all those object d’art in case something happens to them?  The answer I got was no.  So unless we (the city) get a waiver of liability, the art should be removed from the city offices and the event center!  In addition anyone else who wants to display their art should let the city offices know so arrangements can be made to show off their ‘art”
