The First Two Rules of Leadership: Don’t be Stupid, Don’t be a Jerk

David Cottrell

The meeting was called to order with the recitation of the Pledge of Allegiance by Mayor Dan Haeder with Councilman David Larsen, Councilwoman Linda Talbott, Councilwoman Cyndi Peeples, Councilman Lukas Driesen and Councilwoman Darla Reppe.  City Attorney Sam Nelson absent.

Once again FOPAT planted her backside into the seat normally occupied by City Attorney Sam Nelson and once again she interjected her opinion as though she was a council member emboldened by the fact Mayor Haeder allows her to continue to speak without being asked a direct question about bookkeeping.

Agenda Item #3 – Approve Agenda after error was noted by Vickie Larsen (02:17.80)  Mayor Haeder continues on with approval of the Agenda without formally correcting the error. (02:47.83)

Approved Unanimously

Agenda Item #4 – Approve minutes of January 10th and 17th, 2022 meetings

Approved Unanimously

Agenda Item #5  – Public Input

#1 I (Vickie Larsen) asked when I was going to receive my FOIA/Sunshine request.  “Dead” silence and then FOPAT whispers, “I haven’t had a chance to get…” (04:06.27)  Folks this is Par FOPAT as far as my Sunshine requests go, she delays as long as she dares.  So yeah, I used sarcasm to get my point across.  Then the great rush to defend PO FOPAT, Councilwoman Linda Talbott, “…No need to be sarcastic…” and then there is ol’ Mayor Got-FOPAT ‘s-back, “…you’ll get it as soon as possible…” (0:04:26.27)  I continued with my list addressing the Brosz  ‘Pot-O-gold’ offertory.  Any time you add a third party to the billing mix, the price goes up.  So what if they can buy in bulk, that $3000.00 up-front-join-the-buying-club fee will eat up any savings.  Folks we already have the ability to initiate a joint powers agreement with other towns to help off-set costs city projects. While I still had the floor, Mayor Haeder interrupted me prating, “…Next, Next, Next…” (0:04:35.40 through 0:04:37.90)   I went on to my next point, a statement of HRC Financial Condition and where Mayor Haeder babbled about, “…they (HRC) had a meeting, well it really wasn’t a meeting…”  So Mayor Haeder, was it or was it not a meeting.  I asked for the HRC financials, We the People have a right to know! (0:05:31.27)  I went on to my last item which concerned technology in the council room.  I asked if there was an Echo device or Alexa device in the room.  Folks get a load of the maturity of Mayor Haeder who immediately starts hollerin’ for Alexa (0:05:54.17)  And I was called for sarcasm?  Oh that is right, I was called on sarcasm not childishness.  By the way Mayor Haeder, the “wake” word doesn’t have to be “Alexa”, maybe “Dalie” or some other concoction from the list of covert names accessible by FOPAT.  I got no answer.  So Heads-Up folks when you walk into the city offices or any office with a tech-ware, beware you may be recorded.  Check it out for yourselves

The device normally referred to as Alexa is always listening and recording.  Most of us use the ‘wake’ word Alexa but that ‘wake’ word can be changed.  So when Mayor Haeder was doin’ all his grand standing hootin’ and hollerin’ at Alexa, she was listenin’ and recording.

So how-bout-it FOPAT, a FOIA for what Alexa has been listenin’ to and recording for the past few days?

#2  Further Input by Councilwoman Linda Talbot.  Councilwoman Talbott remarked about questions she received about water bills and paying them as well as other issues.

Agenda Item #6 – Police Department – Chief Schuller Updates

Chief Schuller went over the stats with the council.  Councilman David Larsen seem concerned about non-hazardous moving violations resulting in fines or the distinction between non-hazardous violations and the hazardous violations and subsequent fines.  At this point these statistics are not being featured on the website.  They should be public so we, the people can see what our officers are facing each workday and not being played down and interpreted by FOPAT.

Folks let the council know, we need police coverage

Agenda Item #7 – Brosz Engineering – Multi-Community Chip Seal Project

Discussion on the wonderful, wonderful deal the city was going to get if they suckered into Brosz Buying club. (this is sarcasm)  I was there for the presentation and I found certain allegations made in the pitch disturbing.  Question posed, “how do you know you are getting what you are paying for?” Answer we can supervise the project—for a price.  Engineering fees.  Folks we are already mired in an Engineering fee fiasco, so what do you call an engineering feat which causes a run-off flood situation, costs the city an extra $20,000.00 with a lawsuit down the road.  WOW  Mayor Haeder loves the engineers and they must be trusted.  Well let’s see a few engineers who were trusted:  Chernobyl Nuclear Disaster (USSR, 1986), Titanic (UK, 1912), Pennsylvanian Johnstown Flood (USA, 1889), Surfside condominium building collapse (2021), Space Shuttle Challenger disaster (1986), Hindenburg Disaster (May 6, 1937), Deepwater Horizon (April 20, 2010), Tacoma Bridge Disaster (July 1, 1940) and Cleveland Gas Explosion (1940) to name a few of the more spectacular events.  Let’s talk about the Fog Seal (0:16:38.03) cosmetic and no need to sweep.  So Fog Seal is the Mary Kay cosmetic make-over for streets and YAY our Street Sweeping machine never has to leave the garage.  Mayor Haeder prates on, (0:18:12.57) close by!  Closer is better.  So Mayor Haeder why are you promoting a Minnesota contracting applicator instead of a local contracting applicator.  Of course then we have the unsurpassed input of the city bookkeeper (0:25:15.43) and there ya have it, the bookkeeper thinks it is a better product!  The bookkeeper whose hands-on-expertise with road construction is what?  I’ll that to your fertile imaginations.  Mayor Haeder goes on to say, (0:25:26.47) OIL, that sticks in his mind.  Well at least something sticks in his mind.  Per Mayor Haeder, Brosz knows all about it.  Mayor Haeder further blathers (0:25:47.60) speculating the Road Guys might cheat us, oh but not the Brosz Aztec guys ’cause having an engineer (0:25:57.87) involved will protect us.   Yo’ Mayor Haeder tell that to the victims of the depot flooding.  Tell that to the surviving passengers of the Titanic, the Hindenburg, or the survivors of the Surfside Condominium Building Collapse.  I am sure they would be impressed by the perspicacity of you and your minion FOPAT.  (0:27:47.93)  Our community already has had joint powers agreement programs in place to facilitate group buying.  (0:28:05.17) Folks listen to Mayor Haeder as he takes a giant step back and lays the decision for or against solely on the shoulders of the city council.  Evidently he has forgotten that little ol’ power of veto he holds in his ‘lily-white’ hands.  (0:28:28.87)  Now listen as FOPAT comments she doesn’t know about the expertise and competency of  the Road Guys. Yeah madam bookkeeper, you don’t know about expertise nor competency and ya’ll sure don’t know any more about the expertise or competency of Aztec or Brosz other than hear-say from a biased entity. (0:29:57.57) Nice try Mayor Haeder, the State specifies materials used in road bids.  And sir, we do not have any more assurance that Aztec/Brosz will adhere to the standards than the Road Guys.

Left at getting a quote from the local guys, the question was tabled until more information was available.  Folks it is our money, why do we need to pay $3000.00 extra fee.  We can be cheated just as fast by the new guys on the block as we can by local guys.

Just remember you never whizz upstream from where you get yer drinkin’ water, local businesses know this.

Agenda Item #8 – Horizon Health Foundation- Pars for Patients

Approved Unanimously

Agenda Item #9 – Water Pipe Locator Purchase Approval – $6250.00

A handy dandy water pipe locator all for the bargain basement price of $6250.00 which will be taken out of the water fund ($3125.00) and the sewer fund ($3125.00)  WOW  Too bad they cannot use it to locate lost graves in the cemetery, which would prevent selling the same grave plot twice.

Approved Unanimously

Agenda Item #10 – Promissory Note between City of Alcester and Gary McKellips, Interim Donation Shortfall $200,000.00 Community Center Fund-Five year payback (semi annual payments)

Agenda Item #12 – HRC Update

I asked for a Statement of Financial Condition, don’t have one.  H-m-m   I have long commented on the lack of foresight and handling of the property within the HRC and building permit.  The city lives on the allowance (property taxes) our residents give us.  By the manner of building permitting we are fast losing income which is our city budget’s allowance.  No more garage only properties, we lose property tax income on those. (0:54:15.23)  Mayor Haeder just discovered our limited tax liability.  WOW  Ya just figurin’ that one out Mayor?  Ya haven’t been concerned about running competition to our local businesses where our local businesses have to pay property tax and the city can own buildings and not pay one red cent in property tax.  Mayor singled out the HRC and used it as an example where there is no property tax because the HRC an arm of the city does not pay property tax.  I told you a long time ago, didn’t ya have yer ears on Mayor?  Now you’re hot and bothered about lose of taxes on HRC properties.  So Mayor Haeder, what about the city owned Albatross encircling the necks of Alcester City Residents.  Our taxes are going to pay for a gamble by our mayor and his council who are totally ignorant of any kind of business plan for the Albatross.  Not a good money plan in my book.  But Mayor Haeder is tickled silly ’cause we now have lots sold and just one house to one lot.  (0:55:15.23)

Agenda Item #13 – Executive Session Personnel  (SDCL 1-25-2.1) Council went into Executive Session to allegedly discuss personnel.  Folks this is a serious matter, yet ya should have heard the laughin’, caterwauling and loud carrying-ons comin’ out of the council room.  Why all that noise kept Wanda and me awake in the hallway for that whole hour (60 minutes) of executive session.

Approved Unanimously

In Executive Session at 7:02 p.m. and out of Executive Session at 7:57 p.m.

Agenda Item #14 – Vacancy Advertisement

We have a vacancy in the Finance Office and nope not that one, it’s Wanda’s position that is vacant.  We have a vacancy for a custodian and we are looking for a part time cook.  Now we really do not need a deputy Finance Officer, FOPAT does not need a side-kick.  However we do need is a third police officer.  So let’s dump the position of deputy finance officer and add a third police officer to the police department where we really need the help and assistance.  Ask the city council what the stats are, how is our police department handling the influx of calls.  I do not mean the call there is, “a wild pussy loose on Hayden Drive, I mean the 21st century version of a door-to-door peddler selling his/her druggy version of Watkins home-style cures and syrups.”

Motion was made to advertise these vacancies.

Agenda Item #4 – Vacancy Ward II Candidate interviews.

This agenda item was not addressed because there were no candidates to interview.  Folks, Please sign up for council positions.  The seats open for the upcoming election are Ward I – 1 vacancy, Ward II – 2 vacancies, Ward III- 2 vacancies.  If you want change, if you want open city government and you want a Finance Office not strolling the city, window peeping for pet violations, cruising the city streets looking for property maintenance violations, or trolling the computer looking for more fees to add to our property taxes to cover the ‘robbing of Peter to pay Patricia’.

Folks make your voice be heard!

Agenda Item #5 – Public Input

#1      I (Vickie Larsen) (02:08.33) started with the Agenda Item #15

Downtown Garbage cans of the January 10th meeting where FOPAT stated she and Loren Fischer “got together on a proposal to spend city money to the tune of $500.00 a can, 8 cans plus $900.00 shipping fee to be placed downtown Alcester. I spoke to an alternative option (02:15.83).  I spoke to the 11 existing blue cage-type trash receptacles in the city. I suggested the city approach the merchants via the Alcester Chamber of Commerce to see if the merchants would consider purchasing new lids to replace the lost or broken lids but with advertising for their store.  I had researched the cost of those lids to be around $60.00 to $100.00 each.

Second part of my input was to inform the council I had sent a (05:18.70) FOIA/Sunshine request to the Records Custodian (FOPAT) copies of flood plain maps circa 2016 and the most current flood plain map.  Just in case my request got lost in the mail?  It is my understanding some residents have received notification of flood plain status.  Let your council and Mayor know your opinion!

#2      Councilwoman Darla Reppe said she had a bar question but was put off by Mayor Haeder (05:57.60)

Agenda Item #6(06:48.00)  Brosz Engineering-Multi-community Chip Seal Project.

(06:55.30)  Unfortunately Mayor Haeder failed to introduce the representative of Brosz Engineering.  Brosz Engineering Representative, Heidi (nee Larson) Austin gave the Brosz Engineering presentation.

(0:19:59.90) Engineering Service Fees  Estimate $5670.00.  Councilwoman Talbott attempts to confirm total cost and asks the question (21:40.10) this will be an additional $5670.00.  Mayor Haeder opines (21:54.57), “…a whopping five (5) cents more…”  Well sir, if it is so insignificant let’s take that whopping five (5) cents out of your Mayoral paycheck.  Okay?  (32:21.33)  Council elects to delay any decision to move forward until consultation with City Attorney Sam Nelson and further questions on the financing.

Agenda Item #7 – Police Department

(32:29.23) No updates since last Monday.  Question on the agenda is the purchase of a firearm purchase, one (1) AR15 (556 Alexandria Pro Fab)  $975.00  (33:00.50)  This will facilitate to move away from the 1033 program by eliminating and returning the two leased firearms from the Federal Government 1033 program due to increased paperwork and the lack of need for fully automatic weapons.

Approved Unanimously

Agenda Item #8 – Chairperson updates – (39:43.77)   No updates in street, cemetery, water, wastewater, library (new books are in), golf course or finance office.

Agenda Item #9 – Downtown Trash Receptacles (42:39.43) Discussion continues on previous Agenda item #15 (on the January 10, 2022 agenda)  So why aren’t the blue trash bins dumped weekly or each collection day? (43:51.40)

(45:08.53)  FOPAT says, “…must buy cans and take handles off…”  So buy different cans where ya don’t have to remove handles?  Doesn’t take a bookkeeping genius on that one!

(45:28.87)  Oh yes I stand corrected, according to FOPAT SW does not stand for Sewer and Water. It stands for Solid Waste.  I bow to FOPAT’s superior knowledge and apparent hands-on expertise of Solid Waste.

(48:23.83) FOPAT says, “…Those domed lids cost more than that (my pricing information”…on our size can…”  So FOPAT change the size of your can!  So Folks check for yourselves.

This is a 45 gallon Rubbermaid Ranger , HDPP High Density Polypropylene trash container, pedestal container which comes in black*.  This trash container is rated at temperature performance:  -20 degrees to 140 degrees Fahrenheit, it has a capacity of 170 lbs, has a permanently attached hinged top with a metal retainer band to hold liner in place.  Cost $475.00 for one, cost $465.00 for three (3) or more. shipping unknown (https://www.uline.com/BL_8778/Ranger-Trash-Cans)

This is the Eco-Tainer refuse container the FOPAT wants the city to purchase which suitable for interior and exterior use, available in multiple colors, 3 year warranty (under normal use) HDPE-high density polyethylene, and available in 40 and 58 gallon sizes and weighs 58-68 lbs. Load rating of 150-225 lbs depending on size.  Cost $500.00 with no discount for multiple units ordered.  Shipping for 8 units was $900.00  (https://shop.snydernet.com/images/snyder-40-58-gallon-eco-tainer-refuse-brochure.pdf

*  Black generally speaking is the preferred color for outdoor plastic articles.  Black blocks the deleterious UV effect on plastics.

Folks check it out for yourselves.

(49:35.00)  Councilwoman Linda Talbott comments maybe we should just buy four.  Folks check out the prices above.  While I do not have a shipped in cost $465.00 compared to $500.00.  As the mayor says about a $1.00 saved is more than we had!

(52:17.77)  Decals and their adhesives used on polyethylene and polypropylene products can present a problem with the life of a decal.

Agenda Item #10 – Finance Office Updates (57:21.87)

January 28,2022, First day to circulate petitions.  Double check what you need for signatures and then add 10.

Agenda Item #11 – Executive Session 1-25-2 (purpose ?) if needed (58:39.57)

The regular meeting of the Alcester City Council was called to order at 6:00 p.m. by Mayor Tom Glas with the following council present”  Councilman Dan Haeder, Councilwoman Linda Talbott, Councilwoman Darla Reppe, Councilwoman Melissa Kay, City Attorney Sam Nelson and at 6:05 p.m. via Skype, Councilman David Larsen.  AWOL Ward III Councilman Lance Johnson who was going to be late.

*Just prior to the start of the council meeting, Finance Officer Jurrens presented an envelope addressed to me.  I slipped it into my bag without opening it.

The agenda was approved with the exception of the Agenda Item #8 Pool Update to be delivered by Pool Employee Sam Jensen to be moved to just after Agenda Item #4-Approval of June 4th and June 11th meeting minutes.

Agenda Item #8 Pool Update – Sam Jensen delivered the report stating things were going well.  Mr. Jensen was asked the question, if the pool needed to do things differently what would he recommend.  Mr. Jensen stated a new for a new pool vacuum.  Note nothing was asked about the pool rules of Mr. Jensen. I will reiterate, “Folks nothing was introduced on pool slide rules or the imminent danger of injury due to the placement of the slide and rules of use, i.e. pool safety recommendations of  feet first sliding, no head first or backwards sliding , no child under the age of 6 years old without parent in the pool catching, only one child on slide or slide ladder at a time, no toys on the slide and roped off to keep swimmers out of the splash down zone.  I passed out pool slide rules from other sources including a national organization for safety last meeting for the council to read.  Evidently it is not as Finance Officer/Bookkeeper Pat Jurrens puts it, a high priority.  Alcester children it appears are not a high priority.  Imagine your 8 year old or 10 year old suffering a spinal cord injury with the life-long result of tetraplegia or paraplegia because the pool rules were not set or enforced.  Are you willing to bet your child’s future on FO Pat’s ability to distinguish high priority or ignorable priority.  FO Pat’s, Mayor Hal-Glas’d and the city’s pocket are not deep enough to restore what may be lost through sheer ego and terminal stupidity!

Agenda Item #5 Public Input–  I responded for public input, I distributed spiral bound documents for each council member and distributed them to their usual seats at the council table prior to the meeting.  Contained within the document was Safe Routes to School Issue which contained email transcripts between Mr. Kim McLaury of McLaury Engineering, Mr. Rod Gall of the Mitchell Region Office of the South Dakota Department of Transportation and Mr. Dustin DeBoer special Attorney General of the South Dakota Department of Transportation.  I had asked for change orders issued for the substantial grade change, addition of culverts to discharge water build up on the upstream side of the earthen dam the grade change created.  I addressed the unintended (?) consequences of an earthen dam which created a downstream water/flooding issue, the entrapment of standing water which created a breeding surface for insects, the attractive hazard created by a ramp in which children with bicycles were already Evel Knieviling over the new sidewalk with the added prospect of motorcycles, scooters and snow mobiles doing their own version of Dukes of Hazard maneuvers in the park, additional charges for increase thickness of concrete to allow for car and truck traffic implementation of the sidewalk through the park but the sharp grade increase would cause a regular car or truck to bottom out making it useless.  In addition of grading changes in the construction of this project, the north/south alley on the west edge of the Alcester Park was constructively abandoned without public hearings , proper notification to affected residents and notification of abandonment and proper legal steps.  I advised the council of the liability of the ramp, flooding situation and the loss of backyard access could cause lawsuits against the city and city council, jointly and severally.

The second part of the booklet of documents dealt with my Freedom of Information request of the City.  These documents were a collection of FOIA requests and Alcester Finance Officer Pat Jurrens response which simply put was going to cost me $40 per hour for eight (8) hours research time in addition to copying costs.  This maneuver by Mayor Glas and Finance Officer Jurrens has the effect of deliberately closing public records (00:06:13) and creates a violation of Federal and State open records statutes.

I finished up my public input with notification to the council that someone appeared to have vandalized the curb on Anderson Drive across the street from Alcester City Councilman Lance Johnson’s home.  The upper part of the curb had been hacked away from the horizontal plane of the gutter which would allow water to collect and possibly wash away support compactions under the street creating a voids and street collapse.

Also presenting public input were Terry and Jessica Christiansen, owners of the former depot building.  Due to the creation of the earthen dam related to the Safe Routes to School Sidewalk changes has caused flooding in their home and continues to create flooding with each rain event.  It is the Christiansen’s understanding they will have to foot the bill of the poor engineering of the sidewalk which caused damage to their home.  Please note Mayor Half-Glas’d “I (Mayor Glas) was in construction” comments on a cure for the Christiansens. (00:11:25)

Agenda Item #6 – Planning and Zoning  This was the second reading of  the Planning and Zoning Ordinance.

Agenda Item #7 – Street Updates Items of interest is the maintenance of the gravel on West Clark Street, that portion of street running north of the Fairgrounds parking lot.  The grain hauling trucks are complaining the concrete has broken away and have sharp edges.

A one-time burn permit was approved on the 6th street property, I believe this is the future site for the community building and city offices (?)  But as we the tax-payers have received very little information on the proposed community building, design, funding and our input-wise we are as usual in the financial dark.

Agenda Item #10 – Police Department Updates.  Chief Christie brought the council up to speed on new locks, evidence lockers and storage and announced the new hire Kendra was  no longer a part-time officer with the Alcester Police Department, she has accepted the open deputy position with the Union County Sheriff’s office created with the departure of Jeff Christie to take the position of Alcester Police Chief.

The council went into Executive session to discuss personnel at 7:10 p.m. pondered and pondered and pondered until they declared themselves out of Executive session at 8:33 p.m. just shy of an hour and a half. Sheesh!  Either one is fit to be a police officer or not, and it really shouldn’t have taken one and half hours to make that determination.

A curious thing though Chief Christie and OfficerSchuller came out after about 20 minutes or so after the start of executive session.  They were followed a couple of minutes later by Finance Office Jurrens, who remained in her office another 15-20 minutes or so until she was called back into the Executive session meeting.  This finance officer exit was unusual, ’cause unless Finance Officer Pat comes out to retrieve documents, she simply does not come out of executive sessions until they declared out of executive session or…?

Agenda Item #11-Golf Course  Councilman David Larsen gave a brief report via Skype.  He announced the golf course had a health inspection and received a 98 out of 100.

There was an irrigation control issue and has been repaired. However there was an issue where duplicate control boards were purchased.  One control board was purchased independently from the repair guy at $250 and the repair guy brought a second control board and charged the city for it but took a control board away with him.  To be resolved in the future

Agenda Item #12 – Finance Office Update

Warrants were approved with the payment for the diving board was withheld by Finance Officer Pat due to funding.

Safe Routes To School (SRTS) Project sign off and payment of $20K was delayed due to the questions on, specifically who is financially responsible for the apparent omissions and errors.

CDBG Loans-Years ago the city of Alcester received a grant from the state of South Dakota secured by Alcester businessman/ South Dakota legislator Roger McKellips to finance the expansion of Alcester Meats.  Alcester Meats repaid the loan with interest to the City of Alcester which was placed into a special account which the city could extend secondary loans to a primary bank loan by businesses relocating to Alcester or expanding into Alcester, to grow Alcester business district.  These loans were to be repaid with interest to keep the fund alive to encourage new business.  These loans should never have been guaranteed with perishable inventories such as alcohol or disposable commodities.  Finance Officer Pat announced two businesses Alcester Tire and Alcester Steakhouse recipients of outstanding CDBG loans have closed their doors but at this time both extinct businesses are current in their loan payments.

Parking at Alcester City Park included a discussion on the properties immediately North of the Earthen Dam Sidewalk and their loss of access to the rear boundary of their properties.  In other words, the failure of the city to comply with abandonment procedures set by statute.

Personnel Policy Manual-Committee members set as Councilman David Larsen and Councilwoman Melissa Kay with additional committee members to be comprised of employees.  What About City residents input on Personnel Manual?

Consensus for the city to take over the Chamber Website and cause the new website to be the Official Alcester City Website with all the bells and whistles of a genuine city website including, agendas, minutes and city codes on line for residents.

Just before Agenda Item #10, Executive session was called AGAIN to discuss personnel which does not show up on the agenda.  H-m-m!  The council moved into Executive session at 9:15 p.m. and declared out of Executive session at 9:27 p.m.

NOTE:  Alcester City Councilman Lance Johnson never did show up for the meeting.  The late Ward III Councilman just couldn’t seem to come to the meeting to represent his ward.

Agenda Item #17-Adjournment

After motions and vote, Mayor Glas declared the regular meeting of the July 10, 2018, Alcester City Council meeting adjourned
