I am repeating the above quotation due to the abysmal failure of the mayor to do his job to do the right thing!  It has come to my attention that Councilman Curtis Keiser and Councilman Brian Johnson have left the council and rumor has it for much the same reasons as Chief Christie resigned. The right thing would have been to rein in finance officer Patricia Jurrens before the decimation of the police department and the Alcester city council, now it is left to the residents to solve the problem by removing her from the finance office!

I was not present at the September 7, 2021, council meeting, but I did have the meeting recorded for me.  My blog is based upon information from that recording and some judicious sleuthing.   Folks since Mayor Haeder does record the meetings, his recording of the meeting can be procured by Freedom of Information/South Dakota Sunshine Laws.

Mayor  Haeder called the September 7, 2021, city council meeting to order at 6:04 p.m. with the recitation of the Pledge of Allegiance.  Council members present were Councilman David Larsen, Councilman Curtis Keiser, Councilwoman Cyndi Peeples, Councilwoman Darla Reppe and City Attorney Sam Nelson.   Absent were Councilman Brian Johnson and Councilwoman Linda Talbott (01:35.37)

Agenda Item #3 – Mayor Haeder called for Agenda Approval which passed unanimously.

Agenda Item #4 – Mayor Haeder called for approval of the minutes from the August 2nd and August 16th city council meetings.  The council unanimously approved those minutes without changes to what who-ever writes them recorded.

Agenda Item #5 – Mayor Haeder called for the approval of the Watershed/Wastewater Treatment Facility Improvement 2022 – Dale Pearson.  Mr. Pearson reported on the rusting pipes issue at the small shack across the street from our Water Tower which houses the valve joining from the feed pipe from the South Lincoln Water Port located just off  what used to be the Alcester Meats facility to our Water Tower.  The pipe is underground and needs to be lifted to be repaired.  Ideally a larger shed would make repair and future operation easier but Mr. Pearson indicated he felt he could make it work if he had to.  Mr. Pearson did suggest perhaps the City could work with South Lincoln by combining their water port directly to our  water main.  Drawback to that plan is South Lincoln has implemented a Flow Restriction Safeguard and their connection is just off the former  meat pack facility.  Realistic estimated costs to repair pipe/valve connection is $60,000. Mr. Pearson also remarked on the need for a larger control valve in case of emergency.  Given this cost, Alcester has an obligation to its citizens to meter all uses of water ( billed or not billed ) within the city limits. 

          This means the metering and monitoring usage by ALL entities from the pool to the firehouse so the city has a real-time usage of water.  Not necessarily to bill at this time but to have a true concept of usage should we ever have to dial back our water usage.

          Folks we cannot afford to put off the water feed repair.  We cannot afford the loss of any water due to a fore-seeable catastrophe.  No action taken.

Agenda Item #6 – Public Input  Mayor Haeder announced there was about two (2) minutes until the scheduled Public hearing of the Alcester Planning and Zoning Board but he did ask if anyone had any Input.   Aaron Larsen (09:58.20) brought up a problem with the administration of the Facebook pages of the city golf course and the utter lack of over sight.  Mr. Larsen stated he had recently moved back into town and was looking for the fees for the local golf course.  He stated he had talked to golf course personnel asking why the fees and golf course information was not published on Facebook.  He was given the answer that no one had the password to effect a change in information.  Folks I have to ask why wasn’t a copy of the golf course password kept in the golf course file in the city offices?  There was a brief discussion about the Facebook page and announcements.  However, at this point the Public Hearing had to take precedence due to the agenda scheduled time of 6:15 p.m.

Agenda Item #7  Public Hearing – Zoning Medical Cannabis

Agenda Item #7 (a) – (0:15:02.17)Motion to convene jointly as Planning Commission and City Council.  Now folks it needs to be explained about the Planning and Zoning entity and the city council.  I used the word entity because in 7 (a) and 7 (b) the group is named Planning Commission but in 7(e) the group is referred to as the Planning and Zoning Board then it flips back in 7(j) to Planning Commission.  So which is it, Planning Commission or Planning and Zoning Board.  If the Mayor and Finance Officer cannot tell the difference how the devil is the city council members much less the general public supposed to keep up with the musical chair name changing.

7(b) Motion for the Planning & Zoning Board to recommend 2021-17 Ordinance with a second received but no vote taken.  Board members question why no vote. Mayor Ya Mucked Up Buttercup!  Why the devil did you turn and ask the Bookkeeper about the NO vote when ya got City Attorney Sam sitting at yer right hand? (0:17:55.60) Mayor Haeder opens the Planning & Zoning Board meeting to Public Input. (0:18:13.40)  During the public input of the Planning & Zoning Board Mayor Haeder campaigns on approval of proposed Ordinance 2021-17. (0:20:05.97)  Dale Pearson asked a question with regard if the city does not approve the Ordinance 2021-17 what consequence for the city.  Simply put, the State will issue its mandates for the city after which the only changes the city can make to the State mandate is to be more restrictive and cannot relax the mandates issued by the State.  With no further public input for the Planning &Zoning Board, Mayor Haeder moved to further Planning & Zoning Board to discussion just among the board members (0:25:46.57)  At (0:26:50.77)  Mayor Haeder called for a roll call vote.  Councilwoman Talbott was not attending via telephone at this point.  So after the $2232.00+/- Covid money spend on the IPads, why were they in operation for this meeting?  At (0:27:20.23)  Mayor Haeder calls as the Dept. of Redundancy the City Council must now vote.  At (0:27:35.70) Councilwoman Cyndi Peeples makes the motion for the City to approve Ordinance 2021-17 Zoning Provisions.  At (0:28:44.33) Mayor Haeder calls for a roll call vote from the City Council.  Vote unanimous for approval for first reading.  At (0:38:08.60) Mayor Haeder calls for motion on Ordinance 2021-16 Licensing of Medical Cannabis Sales. (0:39:16.80) Mayor calls for roll call vote to approve .  At (0:39:36.27)September 20, 2021, is set for second reading.  At (0:39:54.70)      Mayor Haeder calls for a motion to adjourn the Planning & Zoning Board.  Board is adjourned and the Alcester City Council returns to its regular agenda schedule. 

Agenda Item #6   Public Input (continued (0:40:56.17) )  At (0:43:51.37)  Aaron Larsen continued with his discussion of the Alcester Golf Course/Alcester Golf Club Facebook presence.  Folks here are examples out there I have found  (1) Facebook.com/Alcester- Golf- Course- 291512377591356 , page created April 13, 2012  (2) Facebook.com/Alcester.golfcourse1, created February 1, 2017  (3)  Facebook.com/pages/Alcester-Golf-Club/794477947364425, created December 21/2015   (4) Facebook.com/alcestergolf, created February 19, 2014  with photos of Alcester, UK  Folks evidently no one has a password to any of these?  Now FO Pat wants to drop this sack of flaming Halloween manure (0:42:07.83) on Mr.  Huber’s door step but as you can see the many of the creation dates are long after Mr. Huber’s departure from Alcester City employ.

Agenda Item #8  Legal Updates – Sam Nelson Alcester City Attorney.

(a)  (0:44:47.47)  307 Iowa Street -Nuisance  Once again this is a feature legal issue for the city of Alcester.  Now folks, I believe this issue has been going on for at least one year if not two.  I will look that up.  First let’s deal with the attorney fee per hour on this nuisance.  Back in around 2018 there was a great deal of whizzing and moaning about his legal fees (around $110.00 per hour) from council member, mayor and finance officer.  They took every opportunity to critique our city attorney who was giving the city a discount in his fees because he was a resident and a business owner.  Finance Officer Jurrens publicly badgered, publicly criticized him in meetings, the council would require his presence for an hour worth of council meeting and then dismiss him. Finally Finance Officer Jurrens marched Mayor Glass down to the law office the morning after the city council unanimously approved his legal retainer to tell our City attorney she and the mayor did not feel he was a good fit for the city of Alcester. There was no council vote.  Mr. Haugland understandably rescinded his retainer, yet Finance Officer Jurrens continued to use his work product (without his permission) in her attempts to ‘write’ legal.  Now we have Mr. Nelson and Mr. Frieberg at fees of somewhere around $130-$150 per hour.  Mr. Nelson occupies a chair for an average of 2-3 hours per meeting rarely offering up an opinion unless the city is being sued.  Watch, listen to the video of the meeting.  Here we have Mr. Nelson dealing with this nuisance for a year or more, folks you do the math.  Now let’s deal with the Property Maintenance Code Enforcement Officer Fillingsness.  The city pays Mr. Fillingsness $25 per hour for code enforcement.  The whole purpose of Mr. Fillingsness is to be the face of code enforcement so the Finance Officer or the Mayor do not have to take the heat of throwing people out of their homes.  Now folks if you have ever wondered what Finance Officer Jurrens and Wanda Halvorson are touring the streets of Alcester, taking pictures during the work day?  Do the math first.  Ya got a Finance Officer who is making $30+ per hour, ya got her aid making around $20 per hour wandering up and down the streets of Alcester.  Ya got $50+ /hour  worth of personnel just drivin around takin pictures and writin down addresses.  How long after those afternoon drives do we all-of-a-sudden have property maintenance issues to hand over to $25 per hour Fillingsness (So when is ol’ Fillingsness in town inspecting)and then hand off to $130-$150 per hour legal team.  You do the math.  Then ask yourself, “Who is answering the phones at city hall?”  Yeah right.

          Next up under Legal is the great roll-off question (0:45:27.33) followed up by a language question on ordinance (0:48:44.63).

          Moving on to the (0:49:17.40) to the 2021-11 RV ordinance and the (0:53:53.80) 2021-15 (Attempt to revoke covenants running with the land which is not within the wheel house of the city.)  The relaxing of variances rules.  The variances rules were put into place to protect bordering land owners from encroachment and devaluation of their property by some Yahoo who wants to put a stand along barn/shed.  Part of the existing variance rule in Alcester is it must be an emergency, not just an inconvenience.  Mr. Joe Constance commented on his application for variance and that it apparently was still in limbo He was understandably upset to hear this variance change being expedited while he is still waiting and winter is coming. (1:01:54.00)  Folks listen to Finance Officer Jurren’s response, “…Here is what I will do…”  Here is what you will do Ms. Bookkeeper?  Ms. Bookkeeper it is the council that will be doing, it is their decision!  You have no authority, that lies with the city council!

          October 4, 2021, is the hearing date for the variance.

Agenda Item #9  Police Department

          Updates on the hire of a part-time police officer, hiring a full time police officer and the order for radios.  (1:19:15.67)  Mayor says to Chief Schuller, “if you have any issues, do not hesitate to contact somebody.”  Contact somebody Mayor?  In your own vernacular Mayor Haeder, that somebody is you Buttercup!”

Agenda Item #10  Office Building Door

Quote for exterior entrance door discussion.  Finance Officer Jurrens had contacted Mr. Jami Schempp representing the owner of the old school building to ask about a payment arrangement between the two entities for the $9K+ proposed cost of the door she wanted  Finance Officer Jurrens was annoyed with the answer she received and made the recommendation that (01:26:28.23) “…if they  (the Industrial Board won’t split the bill) I recommend we don’t pay rent this year…”  Bookkeeper Jurrens where do you get off making a threat like you just made?  You are NOT a city council member, you the bookkeeper!  (01:27:20.10)  Now Wanda Halvorson who is also NOT a city council member offers up her unsolicited opinion.  Gee I did not realize this agenda item offered public input!  Whew!

Agenda Item #11  Finance Office Updates

At approximately 7:40 p.m. a call was initiated to City Councilwoman Linda Talbott (01:36:34.63)

(a)  Motion for warrants. Unanimously approved.

(b) 2022 Mayor Haeder Budget was read by Bookkeeper Jurrens.  Evidently the council was not presented to the council before hand therefore they could have read the thing and asked questions.  Evidently this way Bookkeeper Jurrens can have the floor all to herself, drone on and not be bothered with any substantial questions.  Oh yeah, Bookkeeper Jurrens would like a TV for her office (01:44:57.83)  Mayor Haeder calls for a motion to approve the first reading the tardy budget (02:26:19.60)  Call for a roll call vote for first reading with the unanimous approval vote. (02:26:57.07)

(c)  2021-19 Street Maintenance Tax  (02:28:26.33)  voted unanimously.  However folks this little ol’ can be referred.  (02:29:23.20)  Mayor Haeder states every year this fee must be done.  Horse Pucky!  If the budget was properly done and properly handle this extra Tax would not have to be levied.

(d)  2021-20 Wastewater Surcharge (02:30:52.13) Yeah another fee with vague language as to purpose other than get around the deficiency in handling budget adequately.  Mayor calls for motion (02:32:41.60)  unanimous vote.  Folks this too, can be referred.

(e)  2021-21  Water Surcharge Tax/Fee  Charges for new meters and meter reading device.  (02:33:55.30)  Mayor calls for motion to approve this Tax (02:35:03.30)  Unanimous vote, again this can be referred.

I was notified by Councilman Keiser he had resigned via email and requested I remove his contact information from my blog.  Mr. Keiser had asked about the expenditure for computers and why they were not in use.  He did not receive an answer.  Mr. Keiser as a councilman was not provided with one of those computers so he could more effectively take part in city meetings when he was away from the city.  He was disappointed with an expenditure of money for I-Pads which were in effect not put into use.  I am sorry he has resigned.  The council needed a business person as a member who could advise them on the business side of a city.  Thank you for your service.

I also learned Councilman Johnson had left the council apparently much for the same reason Police Chief Christie left.  We are losing good people and that is a shame.

Mayor Haeder called the August 16, 2021,  Alcester City Council meeting to order at 6:00 p.m. with the recitation of the Pledge of Allegiance.  Council members present were Councilman David Larsen, Councilwoman Linda Talbott, Councilwoman  Cyndi Peeples, Councilman Brian Johnson, Councilman Curtis Keiser (via telephonic participation), Alcester City Attorney Sam Nelson with Councilwoman Darla Reppe running late.

Approval of the agenda was called (01:36:.00) and so begins what felt like a quadrimular city council meeting.  There should have been a scoreboard to determine which goal post the mayor and his minions were heading for.  The agenda had some problems, City Attorney Sam wanted the discussion of the nuisance property located at 307 Iowa street to happen in executive session (01:48.37).  Now this property has been on the agenda for the past year in various stages of discussion and mediation.  Now it needs an executive session for legal counsel?  So agenda item 7(a) needs executive session.  Okay.  Motion is made to approve the agenda by adding an executive session to deal with agenda item 7(a).  Motion is made, seconded and further discussion is called.  Yup and so it begins.  City Attorney Sam says, “well we could move that executive session on to agenda item #12 (a) (the perennial just-in-case executive session usually held for personnel)  Mayor thinks that is a great idea.  So now do we amend the amendment, start over or do we consult a parliamentarian ’cause we do not have one of those on the payroll.  Mayor called for vote (02:35.47)  Now is the time for the Parliamentary purge (03:40.47)

Now that other shortfalls of the agenda items list (specifically all those pesky ordinance language) have been effectively obscured, the vote is taken. (04:58.70) Yay!

Agenda Item #4 is called and Mayor Haeder is already cringing. 

I had input, I asked where is my FOIA/Sunshine request from several months ago?  The context of this request for information relates to those properties located in residential areas but are nothing more than storage garages.  Are they using water and are they paying for the water?  Some are, some are not and it appears it is at the ‘discretion’ of the FO and wonder-of-wonders she has property contained within that request.  She has determined this is Top-Secret-Personal information, just as she did with the over-hanging tree citations and refused to comply.  We’ll see.

I had a second subject of input which dealt with 2021-11 the Golf Cart ordinance.(08:58.50)  This ordinance is a joke in that it accomplished absolutely nothing. No penalties and no procedurals for our law enforcement and citation purposes.  Language wording makes the assumption that an adult is the operator of the golf cart.   Please note the language of Ordinance 7.0902 being repealed:  Golf Cart* Operation.  golf carts shall not be allowed to operate within the City excepted as authorized by state statute or by this Chapter.  Golf carts properly permitted pursuant to this Chapter shall be allowed to travel on the roadway portion of public streets, alleys, and other roadways within the City except those highways where golf carts are prohibited by state statute.  An operator of a golf cart shall comply with all City and state traffic rules and regulations applying to vehicles generally, and except that a golf cart shall not be required to have a bell, horn, or directional signals.   

Now compare the language of the New ordinance:  7.0902  Golf Cart* Operation.  Golf carts shall not be allowed to operate within the City except as authorized by state statute or by this Chapter.  Golf Carts properly permitted pursuant to this Chapter shall be allowed to travel on the roadway portion of public streets, alleys and other roadways within the City except those highways where golf carts are prohibited by state statute.  An operator of a golf cart shall comply with all City and state traffic rules and regulations applying to vehicles. (10:34.23) (11:43.23)

*SDLRC  32-14-13 –  Golf cart defined.  For the purposes of §§32-14-14 to 32-14-16 inclusive, the term, golf cart means a four wheeled vehicle originally and specifically designed and intended to transport one or more individuals and golf clubs for the purpose of playing the game of golf on a golf course.  (11:53.37)

*SDCL §58-23-9 – Motor vehicle defined.  For the purposes of § 58-23-8, the term, motor vehicle, means automobiles, motor trucks, motorcycles, and all vehicles propelled by power other than muscular power and designed primarily for travel on the public highway except traction engines, road rollers, farm wagons, freight trailers, house trailers, trailers, vehicles that run only on rails or tracks, and off-road vehicles as defined in § 32-3-1. However, a vehicle not designed for travel on the public highway that is licensed is a motor vehicle for purposes of § 58-23-8. Freight trailers, house trailers, and trailers which are attached to a motor vehicle are part of that motor vehicle. ( Casetext – current with changes from 2021 Legislative Session) (11:53.37)

COUNCILWOMAN TALBOTT  (12:22.57) Councilwoman Talbott stated she had received questions  why there has been no publication for the position of police officer after Chief Schuller was hired as Alcester Police Chief.  (12:32.50)

FO Jurrens response (12:32.50)    

Councilwoman Talbotts response “Two weeks”  (12:43.80) 

Chief Schuller stated he had requested AD COPY from FO Jurrens and got no response. (13:05.90) 

Chief Schuller stated he had written his own AD COPY for the position of police officer, submitted it for approval to Mayor Haeder.  Mayor Haeder approved Chief Schullers proposed AD COPY, so Chief Schuller submitted the AD COPY to FO Jurrens three times and still no response.  Councilwoman Talbott asked the question, “… so will that be getting done soon…?” (13:50.17) 

FO Jurrens whined “…Like I said, it was my intention to do it today…I’m sorry, but nothing about my day was normal today…I’m just one person…” (13:56.17) 

Councilwoman Talbot said, “You know…and I get that but I also get he’s (Chief Schuller) is one person…” (14:06.13) 

Councilwoman Talbott states further, “That is why we need to get something done before he does what our prior chief had to do…” (14:20.03) 

Councilwoman Cyndi Peeples  speaks to the Bar door which has not arrived yet.

Wanda Halverson speaks to the Chamber of Commerce Football book fund raiser.

Councilwoman Darla Reppe spoke of the opportunity to obtain a very early edition of an abstract of Alcester.

 Agenda Item #5 – Wastewater Facility – Presentation of Ms. Leslie Mastrioanni Planner II SECOG (Southeastern Council of Government) regarding funding of the new Wastewater Facility.  Resolution 2021-14 dealt with a vote to move forward on a possible addition of CDBG funding of this project.  No action was taken at this time.

At this point Councilman Keiser’s phone went off-line for the balance of the meeting. 6:40 PM

Agenda Item #6 – Medical Cannabis licensing 2021-16 and zoning 2021-17  Setting up public meetings of the city council and the zoning and planning committee.  The Planning and Zoning committee at this point in time is made up of the entire membership of the Alcester City Council which is problematic in many ways.  The public would be better served if our Planning and Zoning were made of three council members and three regular citizens who own property in Alcester.

2021-16 Licensing of Medical Cannabis was first up, however after the motion and a second to the motion it was determined there was a public hearing time frame issue. Mayor Haeder determined since there was a motion and a second on the floor it would be proper to vote on the issue and with a consensus to vote against the issue and re-do the motion involving both 2021-16 and 2021-17.  So a vote was taken and with a vote of five (5) nays the issue failed.  Again no parliamentarian on site.   

The issue was re-introduced to make room for the time parameters for publication.  Too bad this was not addressed while the agenda was concocted.  Sloppy work.  So the public hearing was set for September 7, 2021, P&Z hearing and recommendation at 6:15 PM with the public hearing of the Alcester City Council meeting to commence at 7:00 to consider the recommendation of the Planning and Zoning committee which is de facto the City Council.  “Hey Abbot   Who is on First? ”

          Agenda Item #3 – Approval of the Agenda.  Mayor Haeder called for approval of the agenda.  The agenda was approved with deletion of agenda item (c) and agenda item (f) changes to Agenda Item #10.  Hey I have a question, so the meeting in September is scheduled for September 7, 2021, and according to

SDCL 9-22-23 Annual estimate by auditor or clerk of expenses and revenue.

The auditor or clerk shall report annually, on or before the first day of September, to the governing body an estimate of the expenses of the municipality and likewise the revenue necessary to be raised for the current year. In municipalities of the first and second class, the budget form shall be similar to that recommended in the municipal accounting manual provided by § 4-11-6.

          Agenda Item #4 – Approval of the Minutes of the July 19, 2021, and July 26,2021, meetings.  Mayor Haeder called for approval of the July 19th and July 26th council meeting with the minutes of those meetings approved as presented.

          Agenda Item #5 – Public Input

I started out asking (for the third time) for Sunshine on certain water bills on non-residential buildings in residential zones.

Mike Bucholz made a complaint against Mayor Haeder and FO Patricia Jurrens (00:06:28.37)  Mr. Bucholz had and continues to be harassed by FO Jurrens with regard to his camper parked in the street.  FO Patricia Jurrens commanded the unit be ticketed and towed.  Mr. Bucholz presented three examples of camper trailers parked on Broad Street since June 14, 2021, asking FO Jurrens, “who owns those campers?”   FO Jurrens did not respond, once again Mr. Bucholz posed the question, “Who owns the camper at 4th and Broad?” and again FO Jurrens would not respond.  Mr. Bucholz stated the camper at 4th and Broad registered owner’s name was Jurrens. (00:07:49.40)  Imagine that!

A gentleman shared his feelings on the upcoming Liquor License and gave support to Acting Police Chief Austin Schuller.  I must apologise, I failed to get the name of this gentlemen.  I would suggest the council ask each person responding with input to give their name.

Another gentleman introduced himself as Eric MacMuller (sp) of Total Stop shared input concerning the Liquor License.

With no further input, this ended the public input until Agenda Item #8 Public Hearing on the Off -Sale Alcohol License for Total Stop scheduled at 6:15 p.m.

          Agenda Item #6 – DANR (Department of Agriculture and Natural Resources-2020 merger of Department of Agriculture and DENR (Department of Energy and Natural Resources) Award Certificates to Dale Pearson and Lonnie Johnson.

          Agenda Item #7 – September Council Meeting rescheduled to September 7, 2021, at 6:00 p.m.   Council approved unanimously to this change.

          Agenda Item #8 – Public Hearing  6:15 p.m.   (00:17:11:60) Hearing on granting an Off-Sale Liquor License to Total Stop.  Mayor Haeder polled the council regarding constituent reactions.  Councilwoman Linda Talbott reported her constituents were against the license grant.  Councilwoman Cyndi Peeples reported her constituents were against the license grant. Remarks and opinions were reported by Kama Johnson-Alcester Bar Employee, Teresa Deem-Alcester Bar Operator, Sherry Total Stop Operations Manager, Joe Constance-interested party, I – Vickie Larsen asked the question was the liquor mark-up going to be applied equitably to Alcester Bar, Total Stop and the Golf Course/Community Building?  Point of information here, the city of Alcester owns the building which houses the Alcester Bar.  This building is leased by the City of Alcester to Deem Enterprises, LLC which operates a bar carrying the name Alcester Bar.

After public comment was complete, Mayor Haeder called for a motion and upon failure to receive a motion to grant, the question died due to lack of motion.

          Agenda Item #9 – Medical Cannabis – Discussion took place on the questions of a Licensing Ordinance and a Restrictive Zoning Ordinance. 

          Agenda Item #10 – Legal Updates

          a)  Nuisance property-still in the works

          b) Vacation of Alley-city cannot abandon by ordinance.  (see Chapter 9-45-7 through 9-45-15) and for an interesting read check out (Chapter 9-45-20 and Chapter 9-45-24)

          c) Garbage – (not ready for consumption…O lord did I just type that?)  Garbage needs more work (still on a roll, guess I will move on).

          d) Ordinance -update of Tile 5, Chapter 5.01 Offenses Against Public Welfare- 2021-13 An ORDINANCE AMENDING THE REVISED MUNICPAL ORDINANCES OF THE CITY OF ALCESTER, SOUTH DAKOTA, TITLE 5-OFFESNCES, CHAPTER 5.01 OFFENSES AGAINST PUBLIC WELFARE, SECTION 5.0108 PENALTY.  5.0108 Penalty    A violation of this Chapter shall be shall be punishable for a fine of twenty-five dollars ($25.00), for each offense.   Folks setting aside rule #1 of writing Ordinance, Thou shall proof-read what thou wrote.

           Ordinance Update of Title 7 – Chapter 7.05 Parking, Stopping. 2021-12  AN ORDINANCE AMENDING THE REVISED MUNICIPAL ORDINANCES OF THE CITY OF ALCESTER, SOUTH DAKOTA, TITLE 7, TRAFFIC CODE, CHAPTER 7.05 PARKING, STOPPING, SECTION 7.0501- PARKING PROHIBITED IN CERTAIN PLACES.  7.0501 (J)

          Folks trying to decipher all the meanderings of legal language from eight different sources and one bookkeeper was nigh unto impossible to keep up with.  So with a phrase here and a phrase there, here a phrase, there a phrase an ordinance was cobbled together enough to earn a first reading.  What is a goat rodeo without a bathroom break!  Oh listen to the Bookkeeper push her agenda (01:30:31:33)  Say, you do realize that a car parked across the sidewalk on Iowa Street is unlawful and that is an ongoing illegal action.

          f) Resolution Personnel Policy Manual, Policy 7 – Leave of Absence Section 7.02(a) Vacation Leave.  Folks this one was not ready for consumption, either.

          Agenda Item #11 Police Department– Call for a motion to go into Executive Session SDCL 1-25-2.1 Personnel, For as many times SDCL 1-25-2.1 has been used in the past eight years the council should know SDCL 1-25-2.1 by heart.  At 7:38 p.m. the council went into Executive Session, at which point the gallery which included Wanda Halverson, Melissa Kay with her phone contact Marcus Ireland, Gordon Richards, Finance Officer Patricia Jurrens and Kerry Hedden moved to the hallway, leaving City Attorney Sam Nelson and Police Chief Austin Schuller in the closed session.  At 8:00 p.m. the council was called back into session where Interim Police Chief Austin Schuller was hired as Full Police Chief with a salary of $23.00/hour dating back to June 5, 2021.   Next item of Police Department business was to publish an ad for police officer.  Wording of the advertisement was reserved by Police Chief Schuller with the approval of the City Council.           a) Street committee update – none

          b) Pool committee- Councilwoman Reppe related a disciplinary incident with a group of boys.  Hey Melissa 0616 I did turn to see your face, so did ya catch the exasperated comment made. (01:52:00.00)  So are ya gonna spend two days a writin’ about that comment like ya did with me in your Confidential Memorandum?

          c) Cemetery committee-  Pine tree fatalities which appear to be lack of attention.

          d) Water-wastewater committee – none

          e) Police/Public Safety Committee -statistics report

I want especially to draw your attention to certain items in Resolution 2021-10 so I have highlighted portions of the document along with definitions and my comments:

SECTION 1 – RECITALS, AUTHORIZATION AND SALES

1.01- Recitals and Authorization:

1.01 (e) – this Council hereby determines that it is in the best interests of the City to authorize the issuance and sale of its Sale Tax Revenue and Refunding Bonds, in one or more series (the “Series 2021 Bonds” together with the Series 2018 Bonds and any additional parity lien bonds authorized hereunder, the “Bonds”), in a principal amount not to exceed the sum of $640,000.00 for the purpose of (i) refunding the Series 2011 Bonds. (ii) funding costs of capital improvements as authorized by the Ordinance, including construction of a community center (the “Projects”), and (iii) paying the costs of issuances of the Series 2021 Bonds, including an underwriter’s discount not exceeding 2.00% of the principal amount of any series of the series 2021 Bonds, original issue discount not to exceed 2% of the principal amount of any series of the Series 2021 Bonds) and bond insurance premium, if any.  The Series 2021 Bonds are issued on a parity (essentially using the same standards) with the Series 2018 Bonds.

1.03 –  City Officers Authorized to Execute Documents.  “The Mayor and Finance Officer are hereby authorized and directed to execute and deliver a Bond Purchase Agreement and the documents require thereunder (archaic expression meaning in agreement of the thing mentioned), the Official Statement, the Series 2021 Bonds and any other documents required to complete the financing contemplated hereby.  Execution and delivery of such documents by the Mayor and Finance Officer shall constitute (give legal form) to evidence that such items are consistent with the terms of this Resolution and have been duly authorized, executed and delivered by the City and are enforceable against the City in accordance with their terms, subject to customary exceptions relating to bankruptcy, reorganization, insolvency and other laws affected creditors’ rights.  The Mayor and Finance Officer are further authorized to take such other actions as may be required to effectuate (put into force) the terms and intent of this Resolution.  In the event of the absence or disability of the Mayor or Finance Officer, the acting Mayor or the acting Finance Officer is hereby authorized to act in the place and stead of the Mayor or Finance Officer, respectively, and to tall all actions and execute all documents approved hereby (as a result of this document).”

1.04 – Official Statement.  “If determined (who is determining?) necessary, the Mayor and Finance Officer are authorized, in cooperation with AMKO, to prepare one or more Official Statements to be distributed to prospective purchasers of the Series 2021 Bonds.  The Mayor and the Finance Officer are hereby authorized and directed to approve, and , if requested, to execute a final Official Statement.”

SECTION 2 –  BOND TERMS, EXECUTION AND DELIVERY

2.01  Execution, Authentication and Delivery.  The Series 2021 Bonds shall be prepared under the direction of the Finance Officer (in my opinion our FO cannot direct a garage band let alone competently prepare a legal ‘promise’ to pay a lender their principal and interest) and shall be executed and authenticated on behalf of the City by the signatures of the Mayor and the Finance Officer and countersigned by an attorney resident and licensed to practice in the State of South Dakota…”

2.04 – Redemption  ” The Series 2021 Bonds may be subject to redemption prior to maturity, at the option of the City, in the years and at the redemption prices set for in an exhibit to a Bond Purchase Agreement… (Call Date – a credit enhancement feature which makes the Bond more attractive to the Bond purchaser such as a higher interest pay rate during the time when the outstanding amounts are at their highest. Call-able loans generally pay a higher interest rate than non-callable loans ie. the city will most likely pay a higher rate of interest for a call-dated Bond loan than a non-call dated Bond )

2.05 – Appointment of Initial Registrar  “The City hereby appoints the City Finance Officer as bond registrar (city employee who maintains the Issuers list of the names, addresses, and other identifying information of Owners of Bonds 2021 Series), transfer agent (she will make sure the investors receive their dividends on time yeah ya really trust that one?), and paying agent (Indenture Trustee or any other Person that meets the eligibility standards for the Indenture Trustee specified in Section 6.11 that has been authorized by the Issuer to make payments to and distributions from the Collection Account, including payment of principal of or interest on behalf of the Issuer. ( the “Registrar”)”

2.06 – Registration The effect of registration and the rights and duties of the City and the Registrar with respect thereto (to this or that) shall be as follows:

2.06(a) – The Registrar shall keep at its principal office a bond register in which the Registrar shall provide for the registration of ownership of Series 2021 Bonds and the registration of transfers and exchanges of Series 2021 Bonds entitled to be registered, transferred or exchanged. (Really?  FOPat has trouble getting payroll out in a timely manner and you want to trust her to handle this?)

Folks these examples are all within the first four pages of the document titled “RESOLUTION NO. 2021-10”.  The Resolution 2021-10 document has 12-14 pages depending how you count.  I embedded the text of the Resolution 2021-10 document in the 07/26/2021 A Voice From the Gallery or you should be able to get a copy of the document from the city office (free) as well as the document must be published in the newspaper and on the Alcester City website.

One interesting item, City Attorney Sam Nelson was not at this meeting to advise the council members face-to-face before they voted.  The council just had to take the word and expertise of the Mayor as they relate to the legal language of this document.  In fact Mr. DeRaney made the statements with regard to his explanation of the Resolution 2021-10 Document, its language and its specifications (0:10:58.33)* and (0:11:02.10)* thatattorneys wrote the document and that he was not an attorney and we all know Mayor Haeder and Bookkeeper Jurrens are most assuredly not attorneys.

While I realize Resolution is not an easy read, I ask the Council members to please re-read the document, I ask the citizens of Alcester to please, please read the Resolution 2021-10 document and if you do not totally and completely understand and agree with what this document is allowing the Finance Officer and Mayor to do please take steps to stop it!

Mayor Haeder called the July 19, 2021, city council meeting to order at 6:00 P.M. with the recitation of the Pledge of Allegiance.  Council members present were Councilwoman Darla Reppe, Councilwoman Linda Talbott, Councilwoman  Cyndi Peeples, Councilman Brian Johnson and Councilman Curtis Keiser.  Absent were Councilman David Larsen and City Attorney Sam Nelson.

Mayor Haeder called the July 19, 2021, Alcester City Council meeting to order with the Pledge of Allegiance.

NOTE-  Folks I was accused of prolonging meetings when I was a council member and it was one of the unfounded accusations used to remove me from my council position.  Please note in this video the number of times Mayor Haeder detoured through the maze of his experiences in this non-council meeting or that non-council meeting or his personal philosophy on weeds and etc.

Agenda Item #3 -Approve Agenda-  Oh, Oh there was a glitch in the Agenda, City Attorney Sam Nelson was absent and the agenda needed to be amended.  Now folks the usual method of making an amendment is to first approve the amendment with a motion which specifically states the change in the agenda, a second to the motion to amend, discussion of the change and a vote to amend.  Second the council must approve the agenda with the amendment attached which requires a motion, a second to the motion, further discussion and finally a vote to approve the agenda.  (02:36:07)

Agenda Item #9(g) Resolution Personnel Policy Manual, Policy 7- Leave Of Absence Section 7.02 (a).  Folks I do not have a final draft copy of the 2020 Personnel Manual as drafted by Melissa Kay.  Unfortunately the numbering system was changed in her draft and again from the version outlined in Agenda Item #9(g).  Here is what I have:  7.2 VACATION LEAVE :

All qualified employees may accrue and use vacation leave (see policy 3- policy 3 deals with employee classifications-Appointive Official, City Employee, Regular Full-time Employee, Part-time employee, Temporary/Seasonal Employee, and Employee with less than six Months of Service) -Schedule – Lengths of Service w/ days of vacation per year so 0-6 mos. of service would earn 3 days of vacation, 6 mos-1 year would earn 5 days of vacation, 2yrs to four yrs of service would earn 10 days of vacation, 5 yrs to 9 yrs of service would earn 12 days of vacation and 10 yrs and above yrs of service would earn 15 days of vacation.  Employees on leave-of-absence without pay or suspensions without pay do not accrue vacation leave benefits. Vacation hours not used during the calendar year in which they are earning may be carried over into successive years.  Eligible employees may accrue a maximum of 45 working days of vacation leave.  Upon accrual above the maximum vacation leave hours, hours accrued will automatically be subtracted down to the maximum allowable hours without time being granted for leave.  It is the employee’s responsibility to ensure that hours are used on a timely basis according to this policy. ***

Upon separation from employment, an employee will be paid for any accumulated vacation time.  Reimbursement for vacation leave will be at the employee’s salary rate per their last day of employment.  When an employee’s vacation time falls on a holiday, such time is not to be subtracted from an employee’s vacation leave balance. Vacation leave must be scheduled with the employees Department Head at the earliest possible time prior to the use of such leave.  The City reserves the right, within reason, to disapprove requested time for vacation leave.  However, the City will make reasonable effort to accommodate employee requests for time off.  Vacation leave will be granted on a first come, first serve basis, based upon operational needs.  The minimum amount that may be charged to an employee’s vacation leave is one hour per leave period.

Employees shall requested the use of vacation leave by filling out a leave request form  The employees Department Head will either approve or deny the request.  The Finance Officer will supply the Mayor and City Council with a full record of vacation time accrued/used for each employee at least one per month.

Comp time must be exhausted before using vacation leave.

Agenda Item #4 – Approve Minutes of June 7, 2021, and June 21, 2021.

Agenda Item # 5 – Public Input

I must apologise for my lack of full clarity in my comments. (0:04:18.73)  I will now attempt to clarify my comments.  First the Sunshine request/FOIA documents I handed to the council.  I have a FOIA/Sunshine request currently open with the Finance Officer Jurrens refusing to comply stating she would not violate personal information.  This was the same, lame excuse she attempted when I asked for freedom of information for the list of notices she sent out for over-hanging trees.  These were public information.  My current Sunshine/FOIA request asked for water-usage information for non-residential properties and which billing is sent out on a post card. 

My second point of input involved prodigious weed growth in the west ditch on South Lincoln Drive at the Alkota property.  As I listened to my video, I found that I did not fully identify the location.  At the spot I was referencing, culverts had been placed in the ditch to accommodate the water run-off from Lincoln Drive.  The ditch was lined with larger rocks to prevent soil erosion which obviously cannot be mowed.  This area is not a duty for Alkota to maintain because the city of Alcester is using it as a run-off area so falls to the city to maintain and keep it weed free.

My third point of input involved FCS and the moratorium on property taxes made by the city of Alcester when the property was annexed into the corporate city limits of Alcester.

Finally I discussed the garden hose stretched out across the park/carnival ride portion of the fairgrounds questioning the wisdom and waste of water and seed two weeks before the fair.  Since the garden hose went to the first street building belonging to FCS, I presumed they were paying for the water.  I have spoke to the council before regarding the water usage amounts by entities not paying for water usage.  Past audits had strongly recommended water usage be tracked even if the city was not charging for the water.  I concluded my comments with the fact we no long pull water from wells, we pay a much high price for the water we get from South Lincoln Rural water than we did from those long ago wells.  It appears we still are not tracking it against audit recommendation and in essence we are being wasteful of our water.

Agenda Item #6 – Community Building Bond- Rescheduled meeting for July 26, 2021, at 6:00 p.m.

Agenda Item #7 – Reschedule Public Hearing Alcohol License.  Meeting August 2, 2021.  At (19:43.23) I asked for permission to speak to the discussion concerning lack of public at public meeting and permission was granted.  Councilman Keiser had brought up the subject of computer participation because he was going to be missing some meetings unless he could participate via a device.  In the past we had routine participate from home by Melissa Kay, Marcus Ireland, David Larsen and others via telephone.  I never heard Mayor Haeder comment about to these folks they really needed to show up in person.  SDCL 1-25-1 OPEN MEETING says, “Any official meeting may be conducted by teleconference as defined in § 1-25-1.2. A teleconference may be used to conduct a hearing or take final disposition regarding an administrative rule pursuant to § 1-26-4. A member is deemed present if the member answers present to the roll call conducted by teleconference for the purpose of determining a quorum. Each vote at an official meeting held by teleconference shall be taken by roll call. If the state, a political subdivision, or a public body conducts an official meeting by teleconference, the state, the political subdivision, or public body shall provide one or more places at which the public may listen to and participate in the teleconference meeting. For any official meeting held by teleconference, which has less than a quorum of the members of the public body participating in the meeting who are present at the location open to the public, arrangements shall be provided for the public to listen to the meeting via telephone or internet. The requirement to provide one or more places for the public to listen to the teleconference does not apply to an executive or closed meeting.  SDCL 1-25-1.2. TELECONFERENCE DEFINED. For the purpose of this chapter, a teleconference is information exchanged by audio or video medium.”

In addition Mayor Haeder, the City can stream the public hearing meetings via Sling Studio.  Surely that technology is not beyond the capabilities of the city bookkeeper.  In this day and age of technology the city surely can find a few coins here and there to pay for the ability of its residents to watch the council meeting live streamed.  I mean Mayor Haeder,  you already video tape the meeting so why not live stream it and put it up on the website.

Agenda Item #9 – Legal Updates – Sam Nelson city attorney.  Mr. Nelson was away so the item dealt with on this agenda item was the Banner Agreement (0:23:09.23) concerning to the best of my knowledge relates to the Waste Water Facility. 

Agenda Item #10 – Police Department – Police Chief Austin Schuller gave his updates.  On a related note, review proposed Ordinance changes.  These changes will create more ‘busy’ work for our police department.  Maybe ‘Karen’ from the Finance Office can hand out the violation tickets and leave the police work to those who have been trained and certified.  Also Mayor Haeder noted if the Police Chief had any questions he could call the Mayor, the Finance Office or the Public Safety Committee.  Call the Finance Office, WHY for pity’s sake. Why would our Police Chief call the city bookkeeper for advice.  It seems from past behavior she has a tenuous grasp on legal issues. (0:29:14.20)

Agenda Item #11 – Department Head Updates – No department heads were present.  Although weeds in the cemetery were discussed along with some choice comments on weed whacking. (0:33:23.20) , (0:34:08.87), (0:34:50.13) and (0:35:14.87)  Mayor Haeder seemed to make excuses for this lapse of cemetery care with his comment (0:33:42.17)  So just who is supposed to be supervising this employee?

Agenda Item #13 – Finance Office Update  Check written to the Road Guy for the final payment for his bid on Chip Seal.  Check written to R&R Construction in the amount of $4,590.00 for Park Street Curb and Gutter Replacement.  Mayor Haeder stated he got a good deal (0:42:39.37)  Doesn’t the Mayor live on Park street? I thought the property owner had to pay that fee. We paid somewhere around $2,500 when we replaced our curb and gutter on Lincoln.  Hired a couple of life guards and the June warrants were approved.

Mayor Haeder called the June 7, 2021, city council meeting to order at 6:00 P.M. with the recitation of the Pledge of Allegiance.  Council members present were Councilman David Larsen, Councilwoman Darla Reppe, Councilwoman Linda Talbott, Councilwoman  Cyndi Peeples, Councilman Brian Johnson, Councilman Curtis Keiser and Attorney Larry Nelson standing in the stead of his son City Attorney Sam Nelson.

Agenda Item #3– Approval of the Agenda – was called, with no changes and no discussion the agenda was approved as presented.

Agenda Item #4 – Approval of the minutes for May 3, May 17, and May 24, 2021 – was called and with no changes and no discussion the minutes were approved as transcribed.  I would like to note here it is uncertain who exactly is taking the minutes.  Is it the Alcester Finance Officer (whose duty it is ), is it the finance office aide Wanda Halverson,  is it those from the city attorney or perhaps a collusion of any two or three of them? H-m-m

Agenda Item #5 – Public Input – Public input was called with three responses. 

First up was Gordon Richard responding as a citizen of Alcester and not as a reporter for the Alcester-Hudson Union newspaper. (02:29.73)  Mr. Richard commented that as a resident of three years in the city of Alcester, he was shocked to hear of Chief Jeff Christie’s departure from the Alcester City Police Department.  Mr. Richard stated he had come to know Chief Christie, to appreciate his work as Chief of Police and recognised Chief Christie’s consummate professionalism in his performance of his profession.  Mr. Richard went on to recommend and request, “is there anything the city can do to atone for the circumstances which led to Chief Christie’s decision?” (paraphrased by me)  Mr. Richard received a less than satisfactory response.

Next to comment was Theresa Deem, local businesswoman and owner of the Alcester Bar. (03:31.10)  Ms. Deem asked the council, “just what is the ‘chain-of-command’ as it relates to the city-owned building she leases and in which she houses her bar operation.  Ms. Deem asked who is on the liquor board (who ostensibly controls the building which houses the Alcester Bar)?  Ms. Deem received an answer which named the council members who sit on that board.  (08:41.23)  Planning and Zoning committee should be made up of three council members and three property owning residents rather than the city council in its entirety.  When the city councils acts as zoning commission it causes confusion for the resident tax payers.  I is redundant and not open government (in my opinion).

Last to comment was Vickie Larsen, me.  (07:51.67)  1)  I started out with my FOIA/Sunshine request #05-07-2021 second request for access to select water-bills for properties ( one of which is under the control of a Hammit Family trust) with only non-residential garages.  I asked for access to the garbage fees charged, the minimum water billing, and street maintenance fees charged and I have been ignored.

2)  I introduced Nacha rules (08:11.33) ( with regard to the proper, prompt pay of payrolls and HSA account set-ups as listed in the May 17, 2021, meeting agenda item #10 which listed HSA Bank Account a. Motion to set up HSA Bank Account, Premier Bank, Dan Haeder, David Larsen, Patricia Jurrens and Wanda Halverson as Signers.(12:36.77) Regarding signers on any account, finance office aid Halverson should not be included on the signatory listed as she is not the mayor, she is not the president of the council and she is not the head of a financing department.  In emergency situations if the mayor is not available the city still has a back up for the dual signage required for official documents.  In addition the part-time aid position was put into place to help Finance Officer Mike Kezar during his time of medical recovery process.  Until that time Finance Officer Kezar was well able to fulfill the duties of the Finance Office on his own with occasional advice from the city attorney, other finance officers and the South Dakota Municipal League.

3)  I distributed handouts to the six council members. (09:03.40)  Contained within those handouts was a document * (nacha.org/content/payments-myth-busting) regarding payroll payments,:” ‘direct deposit payroll will be available in employee accounts by 9a.m. Friday to withdraw or make payments’ and if made Friday morning, ‘the funds will be available to the employee by 5p.m.using the ACH Networks Same Day ACH capability.'” *Another document contained within my handouts to the council was an email exchange between myself and Shaun Van Oort of AB Business Solutions. (vendor from which the city purchased the eight (8) tablets)  An allegation made by Finance Officer Pat Jurrens that I had posed as an employee of the Alcester Finance Office. The date on that email exchange was September 21, 2020, at which time I was a seated city councilwoman.  I was unable to give lie to Jurrens accusation made to the council because I was handed the document generated over two days time (as claimed by Kay) by Councilwoman Kay and was allowed only five (5) minutes to look at the document with no real expectation to read, respond or ability to offer up evidence to support my denial.  In the courts of our land, the accused is given time to offer up evidence and make defense argument. The charge must tell the time, date and place that the criminal act allegedly took place, the alleged involvement of the accused, and the details of the crime itself.  After being notified, the defendant has a certain period of time to file an answer admitting or denying the allegations made in the complaint. This statement by the defendant usually explains why the plaintiff should not prevail. It may also offer additional facts, or plead an excuse.  When I raised those questions, I was told I did not have the right.  *Finally a copy of the May 24, 2021, minutes which described the circus type juggling of proper procedure involving the 2021-09 Ordinance Temporary Ordinance. (09:50.40)  I spoke to the Water Tower which ran out of water.  An alarm had been in place which would send a signal to South Lincoln Rural Water letting them know the level in our water tower was low. at that point they would contact the city so they could stop a water tower failure. Perhaps that should be checked on, maybe the alarm system should be repaired or replaced.

(10:27.20)  I spoke to the donation plea I had received by mail on city letterhead asking for my financial help ’cause there was still $150,000 matching funds waiting for our donation and to be debt free.  Folks check out agenda item #7 Community Center bond.  Doesn’t look to be debt free to me.  In addition, the operational debts incurred by the community center will fall on the good-will, faith and taxes of the citizens of Alcester and those who shop here. 

(11:11.13)  I spoke to the meeting that mayor Haeder and Councilman Curtis Keiser (I believe) had with the Union County Commissioners on June 1, 2021, at 11:00 a.m. in which mayor Haeder attempted to get county law enforcement coverage for Alcester due to the Police Chief leaving as a result of the city attempt to ‘screw the police department’ and mayoral request fell flat.  I told the council of previous attempt to dump the Alcester police department in favor of county sheriff department coverage.  I also told the council to be sure and check with residents of Hudson on how well that has worked for them.  County seat cities do well with County Sheriff coverage but outlying cities don’t.

Agenda Item #6 – Ordinance 2021-09 Mary Jane Ordinance.  Council still messing around with a temporary ordinance.  Finally the council after an amendment to correct Finance Office error in Section 1, line 4 to the correct number of SDCL 34-20G-72 decided to sit on their hands until the state decides what it is going to do.

Agenda Item #7 – Community Center Bond- AMKO Mark DeRaney spoke to the amount of money the city was looking at to pay out for city stated maximum debt on the community building.  Mr. DeRaney stated (26:02.93) “I got a call last week from Pat saying, ‘We need some money to finish up for the community center'”.  Finance Officer Jurrens seems to be using a bait and switch scam where she trims off certain costs of the community building project so it looks more attractive to the taxpayers to get the program passed, only to add those costs-plus-some under the guise of ordinances, fees, bonds and etc. to cover the funds she trimmed. 

(32:07.87)  Councilman Curtis Keiser asks Mr. DeRaney for a definition and clarification of Revenue Bond.  (37:00.47)  Councilman Curtis Keiser asks about the additional amount of $150K.  Now folks there was the land purchase which I do believe was $220K, so is that included in what is now listed at $575K including Underwriters 12% discount, costs of issuance, deposit to Debt Service Reserve Fund (DSRF), deposit to Project Construction Fund and with a Rounding Amount. Agenda Item #9 – Police Department –  mayor announced the appointment of interim police chief, Austin Schuller.  Mayor Haeder stated the necessity of this move as the requirement of  SD DCI (South Dakota Division of Criminal Investigation) to have contact with the Chief of Police, we no longer have a police chief so it was necessary to make an emergency appointment of a police chief and certain predilections of the finance officer to overstep her authority may make it necessary for the DCI to investigate, again. Folks this was the entity which investigated the election violations of Finance Officer Jurrens and which found evidence of credible election violation on the part of the Finance Officer.  Please note mayor Haeder’s comment which relates to how valuable our police chief is and how important making amends to our Chief of Police Jeff Christie for a fellow employee’s retaliatory actions. (46:22.97)  Mayor I can certainly see why you should be ashamed to look Chief Jeff in the eye, when you refused to rein in Finance Office Jurrens and back Chief Christie from the scurrilous excoriations of the all-protected FOPat.  I heard of a previous councilmember comment made we cannot afford to fire/lose the finance officer. As well as another a councilmember comment, “screw the police department”.  WOW  Evidently Mayor Haeder is willing to lose our Police Chief and endanger community safety all in the name of protect the FO.  Screw the police department and we are all screwed.  “We cannot replace our finance officer, SURE we can.  We hire a temporary accountant and we advertise for a new finance officer.  I feel certain there are many young accountants willing to work and do the job of city finance office for us.

Agenda Item #12 – Back Bar Door Replacement – While the Deem’s bar operation should be safe and secure, the $4555.00 price tag seemed high.  I must admit there was no supportive documentation on the requirements of what appears to be one pricy door presented for public consumption.  Now Folks you need to realize it is the city’s expense. not the Deem’s to replace the door of a city owned building.  The city insurance should pay for the costs of door replacement. 

Agenda Item #13 – July 5, 2021, Council first July meeting date moved back to July 12, 2021.  Two council members have stated they will be absent for either of those  meetings dates.  Councilwoman Peeples and Councilwoman Talbott.

ADDITIONAL NOTES:

It was announced during the council meeting the street chip-seal coating was completed Monday, June 7, 2021.  Interesting ’cause it appears Beck Drive and Dakota Street in front of the city offices was chip-sealed, however Union street between Third Street and Second Street is untouched.  This street seems to have been orphaned out of the city street family tree.  Folks residents on the block were left to dig their vehicles out of the muddy mess ignored by the city.  This ‘street’ does not even have enough small to medium pebbles to be called a gravel road, yet the residents are still required to pay the $ per foot street maintenance fee?  Folks go for a ride, see for yourselves the state of that street.

However it seems after months of me mentioning the failure to build a retaining wall on the variance awarded to Sunnyside Storage, it does appear to be in the process of construction.

Oh and one other thing, this has to do with Tiny homes and what can happen with Patti-zoning and Buy-me-a-variance running amok.  The city of Alcester has in the past entertained allowing Tiny homes in Alcester.  Yeah Folks, it might be worth a look-see…There is a tiny home North of Hwy 46 on the east edge of Beresford.  First came the tiny home, then came the tiny-garage and now I noticed another tiny-type storage shed on what appears to be the same parcel of ground.  

In theory it is the same as combining lots along Beck Drive and selling them off for $15K.  Last I knew, the HRC was going to have to sell each lot for $25K just to make the balloon payment and now it appears there is a fire-sale on those properties.

Don’t be afraid of being outnumbered. Eagles fly alone, Pigeons flock together.

Unfortunately I missed the May 24th meeting, however the meeting was taped but due to some technical difficult only the last half hour or so was recorded successfully.

Please note the city attorney was not present and here we have mayor Haeder and FO pat carrying-on without legal counsel. The Special meeting commenced at 6:00 p.m. with Councilman David Larsen, Councilman Brian Johnson, Councilman Curtis Keiser, Councilwoman Cyndi Peeples, Councilwoman Talbott and mayor Haeder present. AWOL were Councilwoman Darla Reppe and City Attorney Sam Nelson. This was a special meeting solely for the “emergency” purpose (if the agenda is to be believed)of discussing the South Dakota marijuana laws and the city of Alcester’s enactment of it’s own ordinances regarding the licensing, dispensing and growing/harvesting of marijuana. So mayor Haeder and FO pat think it is prudent to carry on without the interpretation, language advice of the city attorney? REALLY?

I find it utterly amazing after viewing what video was retrievable, the council weighed in on legal issues without city attorney Sam Nelson present to advise them. Particularly after comments made by former councilman Marcus Ireland and city attorney Sam Nelson concerning semantics and the language of law in the May 17, 2021, meeting.

Take special note that FO pat took up a position in front of the council to spew her hear-say presumably from the city attorney on the issues involved in the abandonment of an alley bordering on the property of Joe Constance. Unfortunately the past council and mayor have religiously accepted the squawkings of the city bookkeeper as she “interprets’ the law and other non-financial agenda items for them. Yeah right. I sincerely hope that the new council persons do their own research.

Another concern is what appears to be a proclivity for the city bookkeeper to seek the advice of the city attorney on her own initiative. WHY? Why is the city bookkeeper requesting legal opinions which results in billable hours, without mayor Haeder or the Alcester City Council formal approval. Dear heaven the council could just as well ask pinterest for an interpretation opinion, oh wait witnessing the hear-say opinion via FO pat it appears they are! Just curious about those phone calls.

MAY 17, 2021 ALCESTER CITY COUNCIL MEETING

Mayor Dan Haeder called the May 17, 2021, city council meeting to order at 6:00 p.m. with the recitation of the Pledge of Allegiance.  Council members present were Councilman David Larsen, Councilwoman Darla Reppe, Councilwoman Linda Talbott, Councilwoman  Cyndi Peeples, Councilman Brian Johnson and City Attorney Sam Nelson.

After the call for Agenda Item #3 Approval of the Agenda Mayor Haeder announced that Agenda Item #10 – HSA Bank Account was no longer necessary, without any explanation as to why it was no longer necessary.  Did the Mayor Haeder/FO Pat decide an HSA was no longer needed, Did the Mayor Haeder/FO Pat decide a separate account was no longer needed, Did Mayor Haeder/FO Pat decide they wanted to use another Bank, or Did Mayor Haeder/FO Pat decide that FO Pat just could not handle direct deposit banking or was this another issue where Mayor Haeder/FO Pat felt the public just didn’t have the right to know.  I strongly suggest folks you ask the council WHY?  Those individuals on tap to be signatories were Mayor Haeder, Council President David Larsen, Finance Officer Patricia Jurrens and Finance Office worker Wanda Halversen.  Council approved the Agenda with Agenda Item #10 – HSA (Health Savings Account) omitted.

Agenda Input #4 – Public Input was called. 

I answered I had public input.  Initially I had planned for a couple items but upper most was my written request to be considered for the Ward III vacancy.  I have made it a practice (depending on the nature of the document) to send requests via email to the entire council and hand-delivering the document in written form with a certificate of service attached to the document for a signature acknowledging the city office did in fact get the document so the document doesn’t ‘disappear’ or ‘get lost’.  However Finance Officer Patricia Jurrens refused to sign the certificate acknowledging document delivery.  So folks now it gets down to a she-said, he-said situation and who is the council going to believe?  Does Bookkeeper Jurrens do this with legal documents, documents from all Alcester residents or just the select few of us that bookkeeper Jurrens deigns as beneath her ( and I do not mean the Kama Sutra-like definition of “beneath” her)?

I stated my request for an interview with the council for the position of council person for Ward III looking for recognition I was indeed going to be allowed to interview with the new council which included the latest council member addition.  As you will note in the video there was a long period of silence after my statement, the council neither accepted nor denied my request.  I did not present any other comments I had for public comment, other than an observation of mini-motorcycles and the apparent age group of the operators on public streets and what appeared to excessive speed relating to their ability to control.

Mayor Haeder called for any additional input to which Miss Melissa Kay responded acting as a quasi telephonic go-between former council member Marcus Ireland and the city council.  Mr. Ireland had two points to make in the public input.  1) Mr. Ireland requested that all proposed ordinances/resolutions be placed on the city website for community full access.  Some community members do not receive the newspaper and therefore lose the ability to comment formally or informally on any proposed ordinances/resolutions before they are passed. 2)  Mr. Ireland offered up comments on the language, semantics and etc. on the issue of medical cannabis and arbitrary denial of permitting for medical cannabis.

Mayor Haeder added his comment on the continued spoofing/scam using his email.

Agenda Item #5 Ward III Vacancy – Interview of candidate – A discussion took place on the need for me to interview, since I had just recently interviewed.  I took the position that since the Ward II vacant seat had been filled and it was appropriate for me to be able to make my presentation to what amounted to a new council.  Executive Session was called and entered into at 6:19 P.M.  My name was called first for interview and I entered the interview session at approximately 6:20 P.M.   I passed out a booklet outlining specific October 2020 historical data I wished to address in full with Councilman Larsen, Councilwoman Reppe, Councilwoman Talbott and Mayor Haeder.  I also want to make sure the two newest additions to the council, Councilwoman Peeples and Councilman Johnson were informed of the facts not hear-say and to off-set former councilwoman Melissa Kay’s comment in the May 3, 2021, council meeting where she willfully breached executive session as it related to me and found in 05/03/2021 A Voice From the Gallery blog and video (0:36:53.23).  I also addressed and enumerated all the accusations and allegations made in that October session to set the record straight with specificity to each allegation/accusation made.  These comments and defenses were directed to Councilman Larsen, Councilwoman Reppe, Councilwoman Talbott and Mayor Haeder who had received what I would characterize as biased opinion and what I would characterize as a false swearing since the allegations were in written form.  Folks I was barred from having an unbiased witness to a interrogation where I faced the city lawyer duly seated at the South Dakota Bar, two wanna-be lawyers who practiced the fine art of legal badgering where, “… Harassment of a witness by legal counsel during questioning, where a witness is subjected to embarrassing or derisive questions where an answer is not expected and serve as argument posing as a question, e.g. who would believe any words coming out of your mouth? ( Badgering the Witness, THELAW.COM LAW DICTIONARY & BLACK’S LAW DICTIONARY 2ND ED. (https://dictionary.thelaw.com/badgering-the-witness/)

Or the prize question asked of me by my interrogator, “…can you read?” 

Also in that city council judgment mix one adds a secretary for a Hawarden attorney, a school teacher, a retired school teacher and a Mayor with a marginal grasp of the job description of a mayor. Folks in Executive Session, if you are the target of the inquisition it becomes she said, she said because there is no record made and in my case no one bothered due diligence into the vacuous accusations.  Just a fear of my honesty, the consequences of my pre-council research on SRTS or my ability to vote No on half-assed, vacuous proposals as explained by the bookkeeper!

I worked my way through the booklet I provided to the council members, page by page, point-by-point and at the end of my presentation I asked for questions.   Folks, the faces on Mount Rushmore have more facial movement than was exhibited by the four faces of those who judged me in that October 7, 2020, meeting.  I had no expectation of being seated but make no mistake I went down fighting with the truth.

Upon my exit of the council room at 6:40 P.M., Ward III Vacancy Candidate Curtis Keiser entered the room for his interview.  At 6:48 P.M. Mr. Keiser left the interview and at 6:50 P.M. Mayor Haeder declared the council out of Executive Session.  At that point motion was called to seat Curtis Keiser as Ward III Councilman and approved.  Congratulations Mr. Keiser on your successful seating.  I will offer my advice to the newest members of the Alcester City Council, Councilwoman Peeples, Councilman Johnson and Councilman Keiser IF the remaining members could do this to me, they can and will the same to you.  Oh yeah, one more thing Finance Officer Patricia Jurrens has no part in Executive Sessions unless it deals with a bookkeeping problem or her own deeds.  She is not the seventh council member!

Call for Executive Session for the purposes of 1-25-2.3 Legal discussion. In Executive Session at 7:03 P.M. -7:14 P.M. Since the next item immediately following the Executive Session under Legal Updates is titled the Boyce Waiver Authorization one can make a presumption of cause and effect (LAWSUIT/ LITIGATION).  (35:30.90) I asked for permission to speak, I asked what the Boyce Waiver Authorization was.  Alcester City Attorney Sam stated this was an authorization to waive a possible conflict-of-interest with Boyce Law.  Folks, Boyce is a Sioux Falls law firm whose area of practice list includes the field of practice described as Alternative Dispute Resolution ( Arbitration and or Mediation).  With that said, Waiver is described as a legally binding provision where either party in a contract agrees to voluntarily forfeit a claim without the other party being liable. Waivers can either be in written form or some form of action.  So the City Council voted to authorize the Waiver.

Still under agenda item #8 Legal Ordinance 2021-09 Temporary Ordinance regarding the Issuance of Local Medical Cannabis permits and/or licenses.  Discussion on what city officials are allowance to do and not do with regard to issuing permits or licenses to sell and/or grow medical Cannabis.

Agenda Item #9 – Deed Transfer from City of Alcester to Alcester Industrial Board described as Parcel 01.01.23.1002, Tract 2, Block 23 Original Alcester City and Parcel 100.00.21.5055. School Lot 2 SE1/4, SE1/4 less 5,676 square feet of Right–Of-Way.  Important question here is the area where the city offices are located and any rents?  Discussion with City Attorney Sam Nelson (54:06.57)  Council voted to approve the Transfer of Deed.  Unfortunately a map of parcels and lots involved in this transfer was not available to the public, therefore for clarity the city office should be contacted for a copy of the exact Parcels involved.

Agenda Item #12 – Executive Session for 1-25-2.1 Personnel was called.  Folks this habit of what appears to be the dodging of open session rules by cloaking  conversations and discussion with impunity outside the realm of the proper Executive Session Rules.  SDCL 1-25-2.1  The council entered into a what has the appearance of a routine, monthly Executive Session for Personnel purposes started at 7:47 P.M. through 8:05 P.M.  No business came out of the session as usual. Agenda Item #13 – Reminders and Update.  One item under was a discussion which dealt with a proposal for the garbage pick-up to remain on one side of the street permanently to, “…save our streets…”  Councilwoman Linda Talbott and et al (1:06:42.5) expressed her opinion that the one-side-of-the-street garbage pickup should stay in force.  How about it folks?  Do you want multitudes of  garbage cans along YOUR street frontage with the Big Blue Garbage cans squatting and drizzling garbage there for three or four days?   HEY LET THE CITY KNOW HOW YOU FEEL!  CALL THE CITY! EMAIL THE CITY!  TELL THEM YOU WANT THE STREETS REPAIRED, FIXED NOT HAVE SOME DIRTY OLD GARBAGIE BLUE BUCKET BANDAID PUT ON THEM.  WE HAVE PAID THE STREET MAINTENANCE FEE FOR THREE OR FOUR YEARS NOW WHERE IS THE MONEY GOING.  FINANCE OFFICER JURRENS WHAT ARE YOU DOING WITH THE STREET MAINTENANCE FEE AND THE REGULARLY BUDGETED FUNDS COLLECTED BY TAX TO REPAIR OUR STREETS?  SO FOLKS ASK WHAT THE ANNUAL BUDGET FOR STREET MAINTENANCE IS WITHOUT THE STREET MAINTENANCE ORDINANCED FEE?  WHAT IS THE SEPARATE  TOTALS OF THE STREET REPAIRS.  FOLKS JUST ONE YEAR WORTH OF MAINTENCE FEE WAS EATEN UP BY THE BILL FOR THE 20 YEAR OLD WHEEL LOADER REPAIR!  THEN THERE IS THE STREET SWEEPER WHICH COST AS I RECALL SOMETHING LIKE $225,000.00 AND IS NOW ONLY USED DURING RAINSTORMS AS I UNDERSTAND IT, IS DUE TO WATER SUPPLY ISSUES.

          Under Fair, “Fair manager Janet Lingle discussed with the board the possibility of the Farmer’s Coop’s plan to build a building on the fairgrounds in Alcester.  Because the county has a lease with city of Alcester for 99 years, the fairboard and commissioners will be involved in this process.  Lingle will gather more information regarding the building.”

          Under Public Auction, “…Discussion took place on the auction items for lease.  Fair manager Lingle and SA Miller present for discussion.  Discussion took place on the current lease agreements.  Motion by Headid, second by Karpen to follow the contract for the penalties in the lease agreement as written.  Motion Carried.”

August 16, 2016, Union County Commissioner Meeting

          Under Lease Agreement, ” Ken Ehrp, Farmers Coop Society, met with the board regarding a lease agreement on county property. (Previous decision-August 2, 2016, minutes) Following a discussion on the lease and the condition of the fairground property, motion by Karpen, second by Headid to follow the contract lease agreement to the full extent.  The fee is $5000.00 and grounds must be restored to its original pre-lease condition.  The fair manager will do an assessment of the property to determine compliance.  Motion carried.  Vote: 3 Aye, 1 Nay, (Schempp) and 1 Abstain (Ustad)  Motion carried.

          “Councilman Mark Dykstra resigned from the Union County Fairboard and according to Councilman Dykstra, “he just could not in good conscience put up with dumping grain on city ground”. He finally ‘got it’ that Mayor Pete Larsen was acting responsibly by forcing the Union County Commissioners to get city permission to sublet the city ground and bar any grain dumping on city property. After Mayor Larsen’s visit with the commissioners, they did run the city ‘fairground’ land sub-leases past the city council. But alas when Mayor Rick Johnson and Mayor Tom Glas took office it appears the commissioners no longer felt the need to get Alcester city approval anymore and with no one to hold their collective feet to the fire, the commissioners got away without city approval.”

August 30, 2016, Union County Commissioner Meeting        

          City of Alcester – “Representatives from the city of Alcester, Mark Dykstra, Thomas Glass and David Larsen met with the board to discuss the $5000 penalty imposed on the Farmers Coop Society (see minutes of August 2 and 16).  Dykstra asked if the county could impose partial fine now and defer the remainder of the balance until 2017; also questions where they $5000 would be placed as the city owns the property-leased to the county for 99 years.  Chairman asked Dykstra if he would be the city council representative on the fairboard as he resigned from the fairboard recently.  He indicated that he would be willing if he was reconsidered for the position.

So Mayor Haeder, irrelevant?

So let’s address the written permissions from the city for the county to sub-lease.  Where are they?   NOT RELEVANT!

Now about the destruction of our land?  Still happening!  So where is the penalty money and the “put-back” to the way it was when the county first leased it.  Who in Hades is watching this?  H-m-m  Mayor you are in charge, where is your over sight?   Lease ends on January 2, 2079.  Just how much more damage can happen? NOT RELEVANT!

Let’s address liabilities mentioned by the sub-leases of the county?  Union County has taken great pains to protect itself from liabilities engendered by its lessees.  In those leases Union County appears to fail to protect the City of Alcester, the Primary Lessor.  NOT RELEVANT? 

So if anyone suffers an injury due to the sub-lease by Union County, apparently the county is protected by their lease but as actual owners of the land, just where does that place the City of Alcester.  It seems to me, the City of Alcester and its tax-paying residents are in the TAG-YOU’RE-IT! end of the line.  NOT RELEVANT?

Now to the water issue.  Repairs?  Check out the lease provisions in the County’s sub-leases with bidders for the City property.  Specifically the Utilities.  Ya know electric, water and so forth.  Oh yeah that water we buy from South Lincoln Water and has been leaking.  Yeah that water, me boyo!  You appear to believe it is okay to delay, play, repairing the leak, instead you are satisfied with turning the water off  to the fairgrounds when the fairgrounds are not in use.  Then when there is a need for water at the fairgrounds, you give someone a wrench to turn the water on and allow thousands of gallons of water to leak.  Ya ever think how many gallons of precious water is wasted?  Ya ever think how much those wasted gallons of water cost us, you remember us…Alcester taxpayers.  NOT RELEVANT?

Folks think about it, the council approved $12, 629.37 repairs to fix a twenty year old wheel loader ’cause it was necessary.  So tell me folks, which is the higher priority, WATER or some relic piece of machinery.  Like the finance officer, the relic machinery can be replaced or rented, WATER cannot be replaced!

Mayor Dan Haeder called the May 3, 2021, city council meeting to order at 6:00 p.m. with the recitation of the Pledge of Allegiance.  Council members present were Councilman David Larsen, Councilwoman Darla Reppe, Councilwoman Linda Talbott, Councilwoman Melissa Kay and City Attorney Sam Nelson with Councilman Marcus Ireland participating via telephone. 

Agenda Item #3 (old council) – Mayor Haeder called for approval of the agenda.  At this point I spoke up (0:03:13.37) and called, “Point of Order” concerning the errors in the agenda which was poorly worded and was improper in agenda item placement, specifically the placement of Agenda Item #5 – public input  under new council after Agenda Items #2 under new council, #3 under new council starting a kerfuffle.  There was a admonition to me, “…you do not have the right…”  I disagree. Mayor Haeder continued with his obdurate question for approval of a error ridden agenda.  Mayor Haeder, it is your job to craft the agenda and make sure the city bookkeeper types it up properly.  Despite my warning about the error ridden agenda, Mayor Haeder got the question of agenda approval as far as discussion phase where Councilman Marcus Ireland pointed out the errors and voice his opinion the errors of language and error of placement be cured before any vote be taken.  So you will hear the kerfuffle of discussions of, “… how do we do this…”  Finally the amendments (change of language and change of order) to the agenda are in place and the approval of the agenda in finally voted.

Agenda Item #4 – Approval of the minutes of April 4th and April 19th council meetings was voted.

Agenda Item #5 – Warrants were approved by vote.

Agenda Item #6 – Adjourn the old council voted.  With that vote completed and Mayor Haeder declared the meeting adjourned at 6:12 p.m..  David Larsen, Melissa Kay went to seats in the gallery and Marcus Ireland remained on the telephone.

Agenda Item new council #1 At 6:14 p.m. Mayor-elect Dan Haeder called the new council meeting to order with Councilwoman Darla Reppe, Councilwoman Linda Talbott, Councilwoman-elect Cyndi Peeples and City Attorney Sam Nelson present.

Agenda Item  new council agenda #2– New Council Oaths

Oath of Office administered to Cyndi Peeples Ward II by City Attorney Sam Nelson and Oath of Office administered to Dan Haeder Mayor by City Attorney Sam Nelson so with Councilwoman Peeples and Mayor Haeder seated the new council moved onto Agenda Item #5 moved forward by amendment during the old council.

Mayor Haeder appointed David Larsen to one of the two vacant Ward II seats, remaining council voted to approve the Mayor’s appointment.  Alcester City Attorney Sam Nelson administered the Oath of Office to Mr. Larsen. (0:20:48.00)

Agenda Item new council #5 – Public Input was called. 

Vickie Larsen responded with comments on the input agenda item placement. 

I raised the question (0:26:14.70) of SLRC Codified Law 9-14-42. Criminal background check of persons seeking employment with municipalities.  Each person over eighteen years of age seeking employment with a municipality shall submit, subject to the discretion of the municipality, to a state and federal criminal background investigation by means of fingerprint checks by the South Dakota Division of Criminal Investigation and the Federal Bureau of Investigation. The municipality may submit completed fingerprint cards to the Division of Criminal Investigation before the prospective new employee enters into service. Upon completion of the state and federal criminal background check, the Division of Criminal Investigation shall forward to the municipality all information obtained as a result of the check. Failure to submit or cooperate with the criminal background investigation is grounds for denial of an application.  Source: SL 2009, ch. 36, § 1.

I questioned last meeting about direct deposit of payroll checks.  Now we have HSA Health Savings Accounts so the city (Finance Officer) needs to add the option of Direct Deposit of those monies (0:26:33.23)

I asked why the wheel loader repair was not bid due to the $12,629.37 price tag (0:27:04.77)  Councilman David Larsen responded (0:30:06.40) the wheel loader is used frequently and the repairs needed a week to complete all repairs.  So I question the procedure of approving the expenditure for the wheel-loader after the fact of repair and without bid.  Councilman Larsen states this was an emergency situation. So was there no routine maintenance plan for this piece of ‘necessary’ use equipment that would have mitigated the magnitude of the repairs?

David Housen (sp) (0:31:48.70)addressed the council to share his interest in purchasing lots 10 & 11 on Beck Drive to build a ranch style. (not a Sh*thouse)

Melissa Kay former Alcester city councilwoman (0:36:53.23) addressed the council to share her opinion on the Ward III vacancy.  I address Ms. Kay as a  councilwoman ’cause her favored form of address ‘alderman’ is defined in the, “A Classical Dictionary of the Vulgar Tongue”, the Second Edition, Corrected and Enlarged by Francis Grose is defined in archaic form using the medial S, “a roafted turkey, garnifhed with faufages, the latter are fuppofed to reprefent the gold chain worn by thofe magiftratef”  and translated to “a roasted turkey, garnished with sausages, the latter are supposed to represent the gold chain worn by those magistrates.”  Heaven help me if I referred to her as a turkey with sausages around her neck.  Ms. Kay alleged ‘mis-conduct’ referring to an executive session in the October 7th meeting of the Alcester City Council and of which I was a seated councilwoman at the time.  At the motion of that executive session and in the discussion before approval, I insisted upon open, public session if the session were to discuss me and that my camera keep rolling to be fully, publicly open.  My concern was a he-said, she-said scenario which I wanted to protect against.   I was told I did not have any right and the closure of the session was to protect the council. I resisted and Alcester Police Officer Schuller had been summoned to be on-hand to forcibly remove my camera and ‘deal’ with me in the event I resisted.  My camera was rolling from the time of the opening of the meeting at 6:00 pm until the time I capitulated approximately 22 minutes later when I shut the camera down and surrendered the camera to Police Officer Schuller who removed the camera from the room.  The video of those 22 minutes of that meeting was not uploaded to my blog for public consumption but gives lie to the accusation of misconduct but does bring the question Ms. Kay your characterization of misconduct was in executive session, no video, no notes yet you feel comfortable bringing this into an open session?

Darla Reppe brought the question of when can bookings be made for the ‘community building”?

Marcus Ireland touched on the Christmas lights in the park.  The Christmas lights will be taken down.  The observation being made if we cannot take the Christmas lights in a timely manner, we should put them up.

With Marcus Ireland’s contribution, Public Input was at an end.

Agenda Item new council #3 – Executive session was called for the purpose of interview of appointment candidates.  The council entered into executive session at 6:44 p.m. Council members remaining:  Mayor Haeder, Councilman David Larsen, Councilwoman Darla Reppe, Councilwoman Linda Talbott, Councilwoman Cyndi Peeples and Marcus Ireland on telephone.

Order of interviews was Vickie Larsen Ward III, Dale Jurrens Ward III and Brian Johnson Ward II.

At 7:53 p.m. Mayor Haeder declared the council out of executive session.  Gallery entered the council room.  Ward III vacancy was not filled, no motion and no action.  Brian Johnson’s appointment to fill the Ward II vacancy was approved by the council four (4) ayes and one (1) abstention. Alcester City Attorney Sam Nelson administered the Oath of Office to Brian Johnson and Councilman Johnson took his seat at the council table.

Agenda Item new council #4 – Election of President and Vice-President of the Council was called with the nomination of Councilman David Larsen as President and the nomination of Councilwoman Linda Talbott as Vice-President.  In separate votes the council approve the nominations of Councilman Larsen and Councilwoman Talbott.

Agenda Item new council #7 – Legal Updates – City Attorney Sam Nelson announced he would be away for somewhere between 30-60 days. Executive Session for legal not needed.

Agenda Item new council #8 – Christmas Lights removed.

Agenda Item new council #9 – Alcester Fairgrounds water-leak.  (1:22:02.67)  Mayor Haeder was approached by Commissioner about a water leak and according to Mayor Haeder the conversation when like this, the commissioner told Mayor Haeder that the county leases this ground from the city therefore the city is monetarily responsible for the cost of repairs around $5K-$10K.  There is a meter in the tree line to the North of the Fairgrounds.  This is a city waterline and the city is charged for the water.  Note in the video ‘they’ and gosh only knows who ‘they’ are have been given a wrench to turn the water on during use of the fairgrounds and off (?) when the fairgrounds are not use.  Now folks to the best of my knowledge this water usage is not assessed to the county and obviously Mayor Haeder appears to be ignorant of the Lease language.  Wanna guess who is paying for that water usage?  (1:26:55.87) I attempted to give the Mayor information about the 99 year lease between the city and the county.  Yeah, the Mayor did not want to know the language of the Lease, he said it is irrelevant.  Really?  Mayor apparently wants to be willfully ignorant.

Agenda Item new council #11 – Executive Session for 1-25-2.1 Personnel not needed – well Ms. Kay doesn’t need to discuss personnel(?) or what-ever-it-was-discussed anymore.

Agenda Item new council #12 – Finance Office- (1:33:49.93) I want to address one  item brought up by Mayor Haeder. Mayor Haeder brought up Mr. Nohava concerning money for Alcester EMS and donations for Alcester EMS.  Folks I would like to take this opportunity to do some math for you my background for this is the fact I handled the books and participated in the billing process for Alcester EMS while I was a part of the service and we responded to 100 medical calls per year.  There was an edict handed to the Alcester public, you will be transported to Hawarden Hospital whether you want to go there or not.  The billing fee for Alcester EMS was $300.00 load fee plus $8.00/per loaded mile for a total of $364.00 for a trip to Hawarden.  For a trip to a Sioux Falls Hospital was the $300 load fee plus $8.00/loaded mile fee for a total of $660.00.  So if an Alcester patient is charged $364.00 the Hawarden trip and then the Alcester patient has to go to Sioux Falls or Sioux City the Hawarden Ambulance (Jeff Nohava?) gets the $660.00 fee.  So the Alcester patient/insurance could possibly be charged $1024.00 for the same medical event.  Last I heard Mr. Nohava is receiving a $22.00/hour consulting fee from Alcester EMS.  In addition, the Alcester ambulance is now responding with the Alcester Fire Department with apparently no billing options but the expenses to roll the ambulance are still accruing.  So on the premise the Alcester EMS had 30 transports per year to Hawarden at $364.00 per call ($10,920.00) plus 70 transports per year to Sioux Falls at $660.00 ($46,200.00) equaling an income of $57,120.00.  Now compare that figure to the mandatory transport to Hawarden $364.00 per trip for 100 trips per year for a total income $36,400.00, a difference of $20,720.00 per year.  That is just the medical transports one has to add the negative operational cost (gas, oil wear and tear) of the ambulance on the fire calls.  Just saying, No wonder the ambulance is leaking money like micro-sand in the proverbial hour glass.
